What is different about filing in the European Union
One EUTM covers all 27 member states for roughly the cost of three national filings, which makes it the default choice for anyone selling across Europe. The trade-off is that it is all-or-nothing: a single successful opposition based on an earlier right in one member state can bring down the whole mark. When that happens the application can be converted into national filings in the unaffected states, preserving the original filing date.
How the EU filing process runs
- Clearance. We check the EU register for earlier marks that would block or narrow yours, before you spend a filing fee.
- Classes and specification. Goods and services drafted to the Nice classification โ too narrow and you leave gaps, too broad and you invite refusal.
- Filing. Filed as a European Union trade mark at EUIPO, covering all 27 member states in one registration.
- Examination. Examination typically within a few weeks of filing โ we respond to any objection as part of the fee.
- Opposition. 3 months from publication. We monitor the window and advise if anything is filed.
Use requirement at filing: no. You can register in the European Union without having used the mark yet, though long-term non-use will eventually expose the registration to cancellation.
Keeping a EU registration alive
Renewable every 10 years. There is no use declaration, but a EUTM unused for five straight years becomes vulnerable to revocation.
Madrid Protocol or a direct EU filing?
European Union has been a Madrid Protocol member since 2004, so the mark can also be reached by designating it from an existing home registration instead of filing directly.
Which is cheaper depends entirely on how many countries you need. For one or two territories, direct national filings usually win. Past roughly three, a single Madrid application generally costs less and is far easier to renew, because everything moves on one date instead of several. We cost both routes before you commit.
