What is an Information Disclosure Statement (IDS)?
An IDS is how an applicant discloses known prior art to the USPTO. Under 37 CFR 1.56 everyone substantively involved in a patent application has a duty to disclose information material to patentability; the IDS, normally on forms PTO/SB/08a and 08b, is the vehicle for doing it. The examiner initials each reference considered, and that record becomes part of the file history.
What exactly do I get for $60?
A completed, filing-ready IDS form set — PTO/SB/08a for US patents and published applications, PTO/SB/08b for foreign patent documents and non-patent literature — formatted to the content requirements of 37 CFR 1.98, with every reference normalised to the correct citation format and sorted into the right section. What do I need to send you?
Your reference list in whatever form you already hold it: a Patent Center or PAIR export, a search report, a spreadsheet, a prior IDS from a related case, or a plain list. Give us the application number and we will normalise the citations, flag duplicates, and return the completed form. Copies of non-patent literature are helpful but not required to produce the form.
When does an IDS need to be filed?
Under 37 CFR 1.97 an IDS is considered without fee or certification if filed within three months of the US filing date or national stage entry, or before the mailing of a first Office action on the merits. Later windows remain open but attach a fee, a certification, or both. Because those deadlines are jurisdictional to your case, confirm them against your own docket — we prepare the form, we do not track your dates.
Does the new IDS size fee apply to my filing?
The USPTO charges an IDS size fee once the cumulative number of applicant-provided items in an application passes 50, then 100, then 200, and every IDS under 37 CFR 1.97 must carry an IDS size fee assertion stating either that the fee accompanies it or that none is due. We show the running cumulative count on the prepared form so you can see which tier you are in before you file.
Do you sign or file the IDS?
No. We prepare the form; your practitioner reviews it, makes the materiality judgements, signs under 37 CFR 1.33(b) and files. We are a preparation service, not counsel, and nothing here is legal advice.
How fast is turnaround?
