There is no single Swedish drawing standard that covers every route out of Stockholm. Which rule book applies depends entirely on where the application is going, and most Stockholm portfolios use more than one route at once.

  • National Swedish filing at PRV โ€” the Swedish Intellectual Property Office (Patent- och registreringsverket), Valhallavagen 136, Stockholm.
  • International filing under the PCT โ€” Rule 11 of the Regulations under the PCT governs sheet size, margins, line quality, lettering and reference signs.
  • European filing at the EPO โ€” formalities are now set by a Decision of the President of the EPO rather than by the Implementing Regulations.
  • US national phase โ€” 37 CFR 1.84, which overlaps with PCT Rule 11 but is not identical to it.

In practice the PCT standard is the useful common denominator. A figure set built to Rule 11 will clear PRV and the EPO with little or no rework, and needs only minor attention before a US national-phase entry. Building to the loosest applicable standard and fixing it later is what generates office actions.

The concrete Rule 11 numbers worth memorising: A4 sheets, margins of 2.5 cm top, 2.5 cm left, 1.5 cm right and 1.0 cm bottom, a usable surface no greater than 26.2 cm by 17.0 cm, durable black uniformly thick lines without colouring, and numerals no smaller than 0.32 cm high. Every reference sign in the figures must also appear in the description, and the same feature must carry the same sign throughout.

PRV is receiving Office, search authority and examiner in one building

This is the fact that most distinguishes Stockholm from other European filing hubs. PRV is not only the Swedish national office. It also acts as a PCT receiving Office, as an International Searching Authority and as an International Preliminary Examining Authority.

An applicant based in Sweden can therefore file the international application at PRV, have PRV perform the international search, and have PRV carry out the preliminary examination. Applicants elsewhere in the Nordic region can select PRV as their ISA or IPEA through the International Bureau or another Nordic receiving Office.

The drawing consequence is direct. The same office that checks your figures against the physical requirements is the office that will search from them, so a figure set that is technically compliant but hard to read costs you twice โ€” once in formalities, once in the quality of the search report you rely on for the next thirty months.

It also means formalities defects surface early. Under PCT Article 14(1)(a)(v) the receiving Office checks compliance with the prescribed physical requirements, and where it finds a defect Article 14(1)(b) requires it to invite correction. Rule 26.2 allows two months from the date of that invitation, and an application that is not corrected is considered withdrawn.

One point of relief: Rule 26.3 requires the receiving Office to check Rule 11 compliance only so far as necessary for reasonably uniform international publication. Small margin deviations usually pass. Grey, low-contrast or anti-aliased line work does not.

The EPC formalities have moved, and Rule 46 EPC is gone

Any guide that still tells a Stockholm applicant to build EPO figures to Rule 46 EPC is out of date, and this matters because a large share of Swedish filings run through the European route.

As part of the EPO’s digital transformation package, Rule 46 EPC was deleted together with Rule 49(3) to (12) EPC with effect from 1 February 2023, and Rules 49(2), 50, 57(i) and 82(2) EPC were adapted to match. The substance was moved into a Decision of the President of the EPO published in the Official Journal, so that presentation requirements can be updated as filing technology changes without amending the Implementing Regulations.

Then the substance itself changed. Since 1 October 2025 the EPO accepts drawings filed by electronic communication in colour or greyscale, provided they are sufficiently rich in contrast and display clearly at 300 dpi. Colour is confined to the drawings; the description, claims and abstract remain black and white.

There is a trap here for Stockholm applicants using the Euro-PCT route, which is most of them. The EPO’s colour concession does not amend the PCT. Rule 11.13(a) still requires black lines without colouring in the international phase, and the EPO will work from a colour version of a Euro-PCT application only where colour drawings are available on PATENTSCOPE and the international publication says so. Filing colour internationally and assuming the EPO will pick it up later is not a reliable plan.

The safe approach for a mixed Swedish portfolio is unchanged: draft in line art that carries the full disclosure in black and white, and treat colour as an EPO-specific enhancement rather than the master version.

Where Stockholm patent disputes are actually heard

Sweden concentrates IP litigation in a way few countries do, and Stockholm is where all of it lands.

The Patent and Market Court (Patent- och marknadsdomstolen) was established on 1 September 2016 as a specialist division of Stockholm District Court. It has exclusive nationwide first-instance jurisdiction over patent, trademark, copyright, design and trade-name disputes, as well as competition and marketing law. Its benches combine legally qualified judges with technically and economically qualified members, so a figure that misrepresents a mechanism will be read by people equipped to notice.

Appeals go to the Patent and Market Court of Appeal (Patent- och marknadsoverdomstolen), a division of the Svea Court of Appeal, subject to leave to appeal. As a general rule it is the final instance in civil patent matters.

Stockholm is also the seat of the Nordic-Baltic regional division of the Unified Patent Court, shared by Sweden, Estonia, Latvia and Lithuania, with hearings also held in Tallinn and Vilnius. The division’s language of proceedings is English, which removes the translation layer that complicates figures in several other UPC venues.

For drawing work the litigation angle is practical rather than formal. Figures filed for formalities compliance are the same figures a court reads years later when construing a claim. Reference numerals that are inconsistent between figures, or that appear in a drawing but never in the description, are exactly the ambiguities an opponent builds an argument around.

  • Telecom and networking. Signal-flow and protocol diagrams carry the disclosure. The constraint is PCT Rule 11.11, which bars text matter in drawings except single indispensable words. Block diagrams and flowcharts get a practical exception because they cannot be read otherwise, but labels belong in the description wherever the numeral can carry the meaning.
  • Software and fintech. Method claims lean on flowcharts and architecture diagrams. Boxes must be sized so that text remains at least 0.32 cm high and still legible after a two-thirds reduction, which is the Rule 11.13(c) scale test.
  • Gaming and interface work. Screen captures are the default instinct and the fastest route to an objection. Raster screenshots fail on line quality and density; interfaces need redrawing as clean line art.
  • Medtech and life sciences. Anatomical and device cross-sections need oblique hatching that does not obscure reference signs, which usually means breaking the hatch where a numeral sits rather than running a lead line through dense fill.

Design protection is a separate track worth flagging. PRV registers designs (monsterskydd) nationally, and Swedish applicants frequently pair a registered design with a patent filing. Design figures follow different conventions from utility figures โ€” broken lines to disclaim environment, consistent shading to show contour โ€” and the two sets should be produced together rather than adapted from one another.
