Patent Drawing ยท Japan

Patent Drawing in Osaka.

A patent drawing Osaka filing is built to JPO Form 30: black-and-white line work only, colour as reference material, and figures that survive Osaka District Court.

A patent drawing Osaka engineer files is examined in Tokyo and, if it is ever litigated, read in Osaka. Those are two different audiences for the same sheet. The Japan Patent Office judges your figures against Article 25 of the Enforcement Ordinance of the Patent Act and Form 30 — black-and-white line work, no colour in the formal disclosure. The Osaka District Court, which holds exclusive first-instance jurisdiction over patent infringement for the whole of western Japan, reads those same figures to decide what the claims actually cover. Kansai’s chemicals, materials, electronics and pharmaceutical filers get caught by the gap between the two more often than by any formality.

Which rules govern a patent drawing Osaka applicant files

There is no patent office in Osaka. Japanese patents are granted by the Japan Patent Office in Kasumigaseki, Tokyo, and no regional bureau examines applications anywhere in Kansai. What Osaka has instead is the court that will read the figures afterwards, which changes how a careful filer draws them.

The formal requirements are short and easy to find, which is exactly why they get skimmed. Article 25 of the Enforcement Ordinance of the Patent Act provides that drawings attached to an application must be prepared in accordance with Form 30. That is the whole delegation: Form 30 carries the sheet specification, and there is no Japanese equivalent of the long formatting schedule in 37 CFR 1.84 — no lettering-height table, no enumerated list of permitted view types, no margin chart written into the statute.

In practice the JPO standard sits closer to the PCT than to US practice. Building to the PCT Rule 11.13 geometry — A4, a sight of 26.2 cm by 17 cm, 2.5 cm top and left, 1.5 cm right, 1 cm bottom, no frames — gives you a sheet the JPO will accept and that also travels to the EPO without redrawing.

Colour is not part of the formal disclosure in Japan

This is the single rule most often missed by filers coming into Japan from a jurisdiction that has recently relaxed. The JPO does not accept colour drawings as formal drawings. Figures entered into the application must be black-and-white line drawings, reproducible and clear.

Colour drawings and photographs can be filed in Japan, but only as reference materials — and reference materials are not part of the formal disclosure. They cannot be relied on to support a claim, and they cannot cure an insufficiency in the formal figures. A micrograph that carries the whole teaching of a materials invention is worth nothing to you if it went in as a reference.

The timing makes this sharper than it used to be. Since 1 October 2025 the EPO accepts electronically filed colour and greyscale drawings, and Spain’s OEPM has allowed colour since 2017. Japan has not moved. A single family prosecuted in parallel now needs a colour set for Europe and a separate, genuinely converted black-and-white set for Japan — converted, meaning the greyscale was redrawn into line work and hatching, not desaturated. A desaturated colour figure loses exactly the distinctions the colour was carrying.

Our note on patent drawings in Japan works through the national practice in full.

Why an Osaka patent dispute stays in Osaka

Japan concentrates patent litigation in two courts, and Osaka is one of them. Under Article 6 of the Code of Civil Procedure, where the relevant place falls within the territorial jurisdiction of the Osaka, Hiroshima, Fukuoka or Takamatsu High Courts, a patent or utility model infringement action falls under the exclusive jurisdiction of the Osaka District Court. Tokyo District Court takes the eastern half of the country; Osaka takes the west. This is exclusive jurisdiction, not a venue preference — a Kansai defendant is not going to be sued in Tokyo, and the choice is not the plaintiff’s to make.

Osaka District Court hears those cases in two specialised intellectual property divisions, the 21st and 26th Civil Divisions. The judges there read figures constantly, which is the practical point: a drawing that is formally compliant but ambiguous about which element is which will be construed, and it will be construed by a bench that has seen the trick before.

Appeals do leave Kansai. Under Article 6(3), appeals in patent and utility model infringement suits fall under the exclusive jurisdiction of the Intellectual Property High Court in Tokyo. Validity is attacked on a separate track altogether, through a JPO invalidation trial rather than as a counterclaim in the infringement action — so the figures are tested twice, by two different tribunals, on two different questions.

The Osaka industries that actually drive local filings

Osaka is not a generic manufacturing city, and the figure work splits along its real industrial lines.

  • Pharmaceuticals. Doshomachi in central Osaka has been Japan’s pharmaceutical district for three centuries and is still the headquarters of Takeda, Shionogi and Sumitomo Pharma, with the Saito life-science cluster in the north of the prefecture. Chemical structures count as drawings, so Markush structures, crystal-form diagrams and XRPD traces all end up on sheets governed by Form 30 — and a diffractogram that depends on colour-coded overlays has to be rebuilt with distinguishable line styles.
  • Chemicals and materials. Sumitomo Chemical, Kaneka, Sekisui Chemical and Nippon Paint anchor a dense materials base. Layer stacks, cross-sections and phase diagrams carry the invention here, and hatching discipline across a multi-layer section is what separates a granted figure from a construction fight later.
  • Electronics and precision machinery. Panasonic in Kadoma, Sharp in Sakai, Daikin in air conditioning and Kubota in agricultural and construction machinery. These are assembly inventions: exploded views, sectional views and consistent reference numerals across a dozen sheets.
  • Batteries and energy. Kansai’s materials and electronics strengths meet in cell and thermal-management work, where the figure set is usually a mix of layer sections, circuit schematics and process flowcharts in one application.

Each of those categories has a different failure mode, which is why a patent drawing Osaka project should start from the technology rather than from a template.

Text in figures and the translation it triggers

Japan’s practical rule on in-figure text is a translation rule, and it decides part of your cost.

Drawings need translating for national-phase entry only where they carry explanatory text. Figures made up solely of lines, reference numerals and view numbers do not require a translation. Labelled flowcharts, annotated graphs and schematics with axis legends do. The saving is real and it is entirely within your control at drafting time: push labels out of the figure and into the description, identify elements by reference numeral rather than by name, and a sixteen-sheet set can go into Japan with no drawing translation at all.

The constraint on the other side is Article 17-2(3): an amendment may not add matter beyond the original disclosure. A figure you clean up after filing has to add nothing. That makes the pre-filing sheet the one that matters, because the cheap fix is not available afterwards.

Routes into Japan and what each does to your figures

Japan is not an EPC state, so there is no validating a European patent into Japan. Protection is obtained by a national filing, a Paris-route filing, or a PCT national-phase entry.

  • PCT national phase. The Japanese deadline is 30 months from the priority date — not the 31 months that applies in Germany or Australia. Getting this wrong is unrecoverable. A transmittal form, Form No. 53, is used for the national documents.
  • Paris route or direct national filing. Twelve months from priority, with the figures prepared to Form 30 from the start.
  • Utility model. Japan registers utility models without substantive examination, and Article 5(2) of the Utility Model Act requires drawings with every utility model application, without exception — because a utility model protects the shape or structure of an article. There is no drawingless utility model filing in Japan. For an Osaka machinery or component maker wanting fast, cheap registered rights, the drawings are not a formality; they are the right.

Because the same family usually runs through the EPO as well, it is worth reading the EPO drawing requirements and PCT drawing requirements alongside Form 30 before any sheet is finalised.

What a patent drawing Osaka project includes

We work from whatever you have — CAD exports, process diagrams, lab photographs, micrographs, instrument traces or a marked-up sketch — and deliver a filing-ready set.

  • Form 30 compliant black-and-white line sheets for the JPO, with a parallel colour or greyscale set where the same family is going to the EPO electronically.
  • Conversion of colour and greyscale originals into line work and hatching that preserves the distinctions the colour was carrying, rather than desaturating them away.
  • Reference numerals reconciled against the description and the claims, and held identical across every sheet.
  • Sectional, exploded and detail views chosen to support the claim language rather than to illustrate the product.
  • Chemical structures, crystal-form data and flowcharts prepared as drawings, since Japanese practice treats them as such.
  • Figures laid out so that labels can be removed into the description, keeping drawing translation out of the national-phase bill.
  • A pre-filing formality check against Form 30, PCT Rule 11 and the EPO standard in one pass.

Seven checks before an Osaka filing goes out

These seven catch nearly every avoidable problem on a Japanese figure set:

  1. Every formal figure is black-and-white line work — nothing colour-dependent survives in the formal disclosure.
  2. Any colour or photographic material is filed deliberately as reference material, and nothing load-bearing depends on it.
  3. Sheets are A4 with no frames, built to the PCT sight so they also clear the EPO.
  4. Reference numerals appear in the description and are identical on every sheet.
  5. In-figure text is reduced to what is indispensable, so no drawing translation is triggered.
  6. The utility model option has been considered, and if taken, drawings are in place as Article 5(2) requires.
  7. The national-phase date is diarised at 30 months, not 31.

Run them before filing and the formalities stop being a risk. Run them after a notification of reasons for refusal and you are paying for the same sheets twice.

Frequently Asked Questions

Which office examines a patent drawing Osaka applicants file in Japan?

The Japan Patent Office in Tokyo. There is no regional patent office in Osaka or anywhere else in Kansai. The formal drawing requirements come from Article 25 of the Enforcement Ordinance of the Patent Act, which requires drawings to be prepared in accordance with Form 30.

Does the JPO accept colour patent drawings?

No. Formal drawings must be black-and-white line drawings. Colour drawings and photographs may be submitted only as reference materials, which are not part of the formal disclosure and cannot be relied on to support a claim.

Why would an Osaka patent case be heard in Osaka rather than Tokyo?

Article 6 of the Code of Civil Procedure gives the Osaka District Court exclusive first-instance jurisdiction over patent and utility model infringement where the relevant place falls within the Osaka, Hiroshima, Fukuoka or Takamatsu High Court districts. Appeals go to the IP High Court in Tokyo under Article 6(3).

Are drawings mandatory for a Japanese utility model?

Yes. Article 5(2) of the Utility Model Act requires drawings with every utility model registration application, with no exception, because a utility model protects the shape or structure of an article.

Do drawings need translating for PCT national-phase entry in Japan?

Only where the drawings contain explanatory text. Figures made up solely of lines, reference numerals and view numbers need no translation; labelled flowcharts, annotated graphs and schematics with legends do.

What is the PCT national-phase deadline in Japan?

Thirty months from the priority date โ€” not the 31 months that applies in Germany or Australia. A transmittal form, Form No. 53, is used for the national documents.
