Riyadh is not just where Saudi applicants file – it is where the office itself sits. Why a patent drawing Riyadh applicant files goes to SAIP alone
Saudi Arabia protects patents nationally, and it does so through one authority. SAIP was established in 2017 and progressively took over the patent function from the King Abdulaziz City for Science and Technology (KACST), which had run the Saudi Patent Office from Riyadh for decades. Both institutions are headquartered in the capital, which makes Riyadh unusual among the cities we serve: the applicant, the examiner and, increasingly, the court are all in the same city.
What matters for a patent drawing Riyadh applicant commissions is that there is no alternative filing route. Saudi Arabia is not a party to the European Patent Convention, so a European patent cannot be validated here – a point worth stating plainly, because clients who file in Europe routinely assume the Gulf works the same way. Protection in the Kingdom comes from a Saudi national application or a PCT national phase entry at SAIP, and nothing else.
That single-gate structure raises the cost of a formalities problem. When an EPO objection lands, the same figures are usually already on file at three or four other offices and the fix is administrative. In Riyadh, a deficiency notice from SAIP stops the only application you have in the Kingdom.
The law behind the sheet: Royal Decree M/27 and its Implementing Regulations
The governing statute is the Law of Patents, Layout-Designs of Integrated Circuits, Plant Varieties, and Industrial Designs, issued by Royal Decree No. M/27 of 29/5/1425H, corresponding to 17 July 2004. It is a single instrument covering four rights, which is why Saudi practice treats patents, industrial designs, layout-designs and plant varieties as branches of one filing system rather than separate regimes.
The operational detail lives in the Implementing Regulations, originally issued by Administrative Decision No. 118828/M/10 of 14/11/1425H (26 December 2004) and amended since – most substantially by the decision of SAIP’s Board of Directors No. 5/8/2019 of 4 Ramadan 1440H (9 May 2019), which brought the Regulations into line with SAIP’s assumption of the office’s functions.
Read them together and the drawing requirement is what a patent practitioner would expect: the application comprises a request, a description, claims, an abstract and drawings where the invention admits of illustration, all in the prescribed form. What the Saudi instruments do not do is set out the granular sheet-level standard that 37 CFR 1.84 provides in the United States. In practice, SAIP applies conventional international formalities, and the sensible working baseline is PCT Rule 11 – which is also the standard your sheets must meet if the application arrives through the national phase.
- Margins and sheet size — A4 throughout, with the clear margins PCT Rule 11.6 specifies and nothing printed in them
- Line quality — durable, uniformly thick, well-defined black lines that survive reduction and reproduction
- Numbering — figures numbered consecutively, sheets numbered separately from the figures
- Reference signs — every numeral in the drawings mentioned in the description, and every numeral in the description shown in the drawings
Arabic is the language of the file, and it changes how you letter a sheet
Arabic is the language of the Saudi register. SAIP accepts filing documents in English, but a certified Arabic translation has to follow within the period the Authority sets – commonly three months from filing. For most of the application that is a translator’s problem. For the drawings it is a draftsperson’s problem, and the two are not the same.
Any text baked into a figure has to be translated, which means it has to be reachable. Labels flattened into a raster export, lettering converted to outlines in a vector file, or type embedded in a screenshot all force the same bad choice later: redraw the sheet, or file a figure the examiner reads in a language the register does not use. The fix is boring and effective – keep text in editable layers, and keep it out of the drawing wherever a reference numeral will do the job.
The deeper discipline is to design figures that carry almost no text at all. A numeral-driven drawing is language-neutral: it reads identically in the Arabic file, the English priority document and the PCT publication, and it needs no retranslation when the family extends. That is the approach we take on every patent drawing Riyadh project, and it is the single change that most reduces downstream cost for a Saudi family.

Three routes into the Kingdom, and the one that closed in 2021
Applicants coming to Saudi Arabia for the first time frequently ask about the Gulf patent. It is worth being precise about what happened to it.
The GCC Patent Office stopped accepting new applications on 6 January 2021. Applications already on file continued to be processed, but the unified Gulf patent – one filing enforceable across all six member states – is no longer available to new applicants. The office resumed operating in 2023 in a different role, as a central examining authority handling applications forwarded by national offices, and as matters stand only Bahrain, Kuwait and Qatar route work through it. Saudi Arabia does not. Saudi applications are examined by SAIP.
That leaves two live routes, both ending at SAIP in Riyadh:
- Direct national filing at SAIP, with Paris Convention priority where a first filing exists elsewhere
- PCT national phase — Saudi Arabia has been bound by the Patent Cooperation Treaty since 3 August 2013, with national phase entry at the 30-month deadline
The national phase route has a practical consequence for drawings that is easy to miss. Your sheets will already have been published by WIPO before SAIP sees them, so the figures the Saudi examiner reads are the figures you filed internationally. Correcting them at national phase entry is possible but constrained – you cannot add matter, and a redrawn figure that shows more than the published one will be refused. The drawings have to be right at the PCT stage, not at the Riyadh stage.
SAIP examines substantively, and there is a fast track
Saudi Arabia is not a registration system. SAIP conducts substantive examination for novelty, inventive step and industrial applicability, in addition to the formalities check that comes first. That distinguishes the Kingdom from several of its neighbours and from jurisdictions such as South Africa, where grant is essentially a registration act.
The order of events is what matters to a draftsperson. Formalities are examined before substance, so a defective sheet delays the substantive stage rather than being tidied up alongside it. A missing reference numeral or a margin violation costs a response period before the examiner has looked at the invention at all.
SAIP also operates accelerated examination arrangements, including a Fast Track Examination programme and Patent Prosecution Highway cooperation with partner offices. Both reward a file that is already clean: acceleration compresses the time available to fix formal defects, so an applicant who enters a fast track with drawings that will not survive the formalities review has bought a faster route to the same objection.

Saudi industrial designs are a separate filing with different drawings
Royal Decree M/27 covers industrial designs in the same statute as patents, but the drawing brief is not the same, and treating the two interchangeably is the most common error we see on Saudi work.
A utility figure exists to show how something works: section views, hidden detail in broken lines, hatching that identifies materials, numerals tying every element back to the claims. A design figure exists to define appearance, and it is the drawing itself that constitutes the protected subject matter. Shading carries the contour. What you choose to leave out of the claimed design is as consequential as what you put in.
US practitioners have a useful reference point in 37 CFR 1.152, which requires a design to be represented by drawings complying with 37 CFR 1.84 and containing enough views for a complete disclosure of the appearance, permits broken lines for visible environmental structure but not for hidden planes, and forbids solid black surface shading except to represent the colour black or colour contrast. Saudi practice is not governed by those rules, but the underlying draughting logic transfers directly, and a design set built to that discipline gives a Saudi examiner an unambiguous record of what is claimed.
If a Riyadh client is filing a product where both the mechanism and the look have value, the answer is usually two filings and two drawing sets – not one set of figures asked to do both jobs.
What Riyadh actually files, and what those figures have to show
Riyadh’s filing profile is distinctive, and it is not the oil-and-gas caricature. The upstream energy patents largely come out of the Eastern Province. What the capital generates is institutional and infrastructural.
- Research institutions — KACST and King Saud University are among the Kingdom’s most consistent patent filers, and both are Riyadh institutions. Their output skews to materials, chemistry, water treatment and biomedical devices, all of which are drawing-heavy in the ways examiners scrutinise most: process schematics, apparatus cross-sections and micrographs.
- Giga-project construction and building systems — Diriyah, Qiddiya, New Murabba and the Riyadh Metro have pulled a large volume of modular construction, facade, HVAC and vertical-transport engineering into the capital, filed by contractors and their suppliers.
- Water, desalination and environmental technology — a durable Saudi filing category, and one where the invention is almost always a flow diagram plus an apparatus figure rather than a single device drawing.
- Fintech and payments hardware — the King Abdullah Financial District and the Riyadh regional-headquarters programme have brought filings that need clean system architecture and flowchart figures.
- Defence and industrial manufacturing — localisation programmes run from Riyadh, with mechanical assemblies that demand exploded and sectional views.
Two of those categories deserve a specific warning. Flowcharts and system diagrams are where reference-numeral discipline collapses most often, because the boxes feel self-explanatory to the engineer who drew them and are not self-explanatory to an examiner reading a translation. And micrographs or photographs, common in the university filings, are only acceptable where the subject genuinely cannot be shown in a line drawing – they should never be a shortcut around commissioning a proper figure.
Where the drawings are eventually tested: SAIP’s committees and the Commercial Court
Drawings are drafted for an examiner and eventually read by a judge. In Saudi Arabia both are in Riyadh, and the enforcement structure has changed materially in recent years.
SAIP administers its own quasi-judicial committees for IP violations, which handle complaints of infringement and impose the penalties the Law provides, with a right of appeal against a committee’s decision. Alongside that, the Commercial Courts Law – issued in 2020 and in force from mid-2020, reinforced by a Supreme Judicial Council circular of 15 March 2021 – conferred jurisdiction on the commercial courts over cases and violations arising from the application of the intellectual property regulations. In practice that means substantive IP litigation is heard in the Commercial Court, with Riyadh’s court taking the bulk of the Kingdom’s patent work.
Judges hearing these disputes are commercial judges, not technical specialists, and they work from an Arabic file with the assistance of court-appointed experts. That is the audience your figures are ultimately drawn for. A drawing set that requires the reader to reconstruct the invention from a dense schematic will be mediated through an expert report; a drawing set that shows the claimed structure in a clean sequence of views does part of the persuasion itself.
It is also the reason we keep every numeral consistent across an entire family. A Saudi infringement action will put the Arabic file, the PCT publication and any US or European counterparts in front of the same expert. Divergent numbering between them is an invitation to argue that the documents describe different things.
