Dubai is where the filing decision is made, but it is not where the application is examined. Why a patent drawing Dubai applicant files is governed federally

The UAE protects industrial property at federal level. The relevant instrument is Federal Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights, published in the Official Gazette on 31 May 2021, which replaced the former patent law, Federal Law No. 17 of 2002. Its Executive Regulations were issued as Cabinet Decision No. 6 of 2022. Between them they cover patents, utility certificates, industrial designs, integrated circuit layout designs and undisclosed information — and they apply throughout the country, including inside the free zones.

For a Dubai-based applicant, that has a practical consequence worth stating plainly: there is no separate Dubai filing, no emirate-level formalities standard, and no drawing rule that changes because your trade licence was issued by DED rather than in another emirate. The office that receives your sheets is the Ministry of Economy and Tourism, through its intellectual property department, and the standard is the same one applied to an application filed from Abu Dhabi, Sharjah or overseas.

What is genuinely local is the commercial context: which companies file, what they file on, and which court hears the dispute when the patent is later asserted. Those three things are what this page is about, because the formal rules are national and the strategy is not.

Formalities first: how the Ministry reviews a UAE application

A UAE application is checked for formal compliance before anything substantive happens. Filing particulars, the description, the claims, the abstract and the drawings all have to be present and in the prescribed form under the Executive Regulations; a deficiency generates an office communication and a period to correct it, and the clock on that period is short by the standards most foreign applicants are used to.

Substantive examination is a separate stage, and it is where UAE practice differs from most national offices. The Ministry has for years carried out substantive examination through cooperation arrangements with foreign patent offices rather than entirely in-house, which is one reason the substantive phase in the UAE has historically been measured in years rather than months. The practical implication for drawings is straightforward: your figures will be read by an examiner working from a translated file, at a remove from the applicant, with no opportunity for the informal clarification a local interview might provide.

That argues for figures that are self-explanatory rather than merely compliant. Consistent reference numerals across every view, a numeral for every element the claims recite, no element numbered twice, and no numeral in the drawings that the description never mentions. Those are the same disciplines the PCT imposes in Rule 11.13, and they travel well into a file that will be examined at arm’s length.

  • Formalities examination — completeness and prescribed form of the application documents, including the drawing sheets
  • Publication and substantive examination — novelty, inventive step and industrial applicability, conducted with foreign examining-office cooperation
  • Grant and annuities — annual fees run from filing and are payable to keep the right alive
  • Utility certificate — a shorter, lower-threshold right for inventions that do not clear the inventive-step bar

Arabic is the language of the file, and it changes how you letter a sheet

Arabic is the language of the UAE register. Applications are accepted with English documents, but Arabic is required for the filing record — in practice the title and abstract in Arabic, with certified Arabic translation of the application text. That requirement is administrative rather than aesthetic, and it has a direct effect on how the drawings should be prepared.

Every word you letter onto a figure becomes a translation item. A flow chart with twelve English legends is twelve more strings to translate, twelve more chances for a mismatch between the sheet and the translated description, and twelve more places for an inconsistency to surface years later when the patent is being construed. The cure is the one both the PCT and US practice already push you toward: carry the meaning in reference numerals and keep text matter on the sheets to the minimum the figure genuinely needs.

Where text is unavoidable — the boxes of a method flow chart, a legend on a waveform — keep the wording identical to the phrasing used in the description, so the translator produces one Arabic term rather than three. It is a small drafting discipline that costs nothing at preparation and saves a great deal at translation and, later, at enforcement.

Three routes into the UAE, and one that closed in 2021

A Dubai applicant reaches the UAE register by one of three routes, and it is worth being clear about the one that no longer exists. The GCC Patent Office stopped accepting new applications on 6 January 2021. A single Gulf-wide patent is no longer available for new filings, so protection across the Gulf is now obtained country by country — the UAE Ministry, SAIP in Saudi Arabia, the Qatari ministry and so on. Any advice that still routes a Gulf strategy through a GCC filing is out of date.

  1. Direct national filing at the Ministry of Economy and Tourism, with or without a Paris Convention priority claim from an earlier first filing.
  2. PCT national phase. The UAE is a PCT contracting state, and national phase entry is due at 30 months from the priority date. Treat that as a hard date.
  3. Utility certificate, either filed as such or converted, for technically useful subject matter that will not clear the inventive-step threshold.

One route is not available and is a recurring source of confusion in Dubai boardrooms with European parents: the UAE is not a party to the European Patent Convention. A granted European patent cannot be validated into the UAE the way it can into Germany or Sweden. If the UAE matters to the business, it needs its own filing.

Where the case entered through the PCT, the drawings that go into the national phase are usually the international sheets. That is efficient, and it is also the moment to check them. PCT Rule 11.13 requires lines and strokes that are durable, black, sufficiently dense and dark, uniformly thick and well defined, a scale that survives linear reduction to two-thirds, and numbers and letters at least 0.32 cm high. Sheets that were waved through by the receiving office are not always sheets that read well after translation and reproduction.

Designs are a different filing with different drawings

Industrial designs sit in the same federal law but they are a separate right with separate representations, and the mistake we see most often in Dubai consumer-products and luxury-retail filings is a design application illustrated with engineering drawings borrowed from the utility file.

A design filing protects appearance. The representations therefore have to show the article as it looks — a consistent set of views, consistent lighting and orientation, no construction geometry, no dimensions and no annotation that describes function rather than form. Views that contradict each other are the classic failure: a handle that appears in the perspective view and not in the side elevation invites a question about what exactly is being claimed.

Two international points matter for planning. The UAE has acceded to the Locarno Agreement, so design classification follows the international classification. But UAE design protection is obtained by national filing at the Ministry rather than through the Hague international design system, so a Hague application will not deliver the UAE. Budget a national design filing, and budget a distinct set of representations for it.

What Dubai actually files, and what those figures have to show

Dubai’s filing profile follows its economy rather than a research base, and it is unusually weighted toward systems and infrastructure rather than pure chemistry or pharma. Four clusters generate most of the drawing work we are asked to do here.

  • Logistics and ports. Jebel Ali and the wider re-export economy drive filings on container handling, automated sortation, cold-chain packaging and tracking hardware — cases that live or die on assembly views and exploded views rather than on a single hero figure.
  • Aviation and MRO. A major hub carrier and a substantial maintenance sector generate component, tooling and cabin-systems filings, where sectional views carrying correct hatching do most of the disclosure work.
  • Water, cooling and solar. Desalination, district cooling and large-scale photovoltaic deployment produce process and plant inventions best carried by schematic flow diagrams with rigorously consistent numerals across every figure.
  • Fintech and retail hardware. Payment terminals, kiosks and the interfaces that run on them, where the protectable subject matter is often split between a utility filing for the mechanism and a design filing for the housing or the screen.

Two of those clusters — process plant and software-driven fintech — are the ones where drawing strategy most often goes wrong. Process inventions get one over-crowded schematic instead of a block diagram plus detail views; software-driven products get no figures at all, on the theory that there is nothing to draw. Both are avoidable, and both are cheaper to fix before filing than after.

Where the drawings are eventually tested: Dubai Courts and the DIFC

Dubai runs its own judiciary. Unlike the emirates served by the federal court system, Dubai has a local court structure — the Court of First Instance, the Court of Appeal and the Court of Cassation — and a patent infringement action brought onshore in Dubai starts in the Court of First Instance, with points of law reaching Cassation. Proceedings are in Arabic, and technical questions are typically put to a court-appointed expert whose report carries very substantial weight.

That expert is, in practice, the first person outside the office to read your figures adversarially. A drawing set that is internally consistent, correctly numbered and legible after reproduction gives the expert something to work from. One that is not hands the other side an argument about what the patent actually discloses.

Dubai also hosts the DIFC Courts, a common-law, English-language forum whose jurisdiction runs to claims connected with the DIFC or brought there by agreement of the parties. It is well used for contractual disputes — licences, development agreements, assignments — rather than as the default venue for infringement of a federally registered patent. Where the onshore and DIFC courts both appear to have jurisdiction, the conflict is resolved by the Joint Judicial Committee established under Dubai Decree No. 19 of 2016.

The planning point is that a Dubai patent can end up in front of an Arabic-language onshore court, an English-language DIFC bench on a contract question, or a foreign tribunal under an arbitration clause. Figures that need a narrative to explain them do badly in all three.
