Since the regional shortcut closed, there is only one honest answer to how to file a patent in United Arab Emirates: nation by nation, through the UAE Ministry of Economy. The old Gulf Cooperation Council patent, which once covered six states with a single grant, stopped accepting new applications on 6 January 2021. For a foreign applicant that changes the math — the routes, the translations, and above all the deadlines. Miss the 30-month window and you lose the Emirates entirely, with no revival. This guide walks the seven decisions that actually matter.
How to File a Patent in United Arab Emirates: Three Routes

Protection in the Emirates is governed by Federal Decree-Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights, which repealed the old Federal Law No. 17 of 2002 and is implemented by Cabinet Resolution No. 6 of 2022. Everything flows through the UAE Ministry of Economy, which handles patents, utility certificates, designs and layout-designs. There is no longer a regional filing office, so you choose among three national routes.
- Direct national filing — file straight with the Ministry of Economy. Suited to an applicant with no earlier foreign application, or one treating the UAE as a first filing.
- Paris Convention route — claim priority from an earlier application filed elsewhere, provided you file in the UAE within 12 months of that first filing. The 12-month term is firm and non-extendable.
- PCT national phase — for most international applicants this is the workhorse. Enter the UAE national phase from an existing PCT application within 30 months of the priority date.
For a startup or in-house team already running a PCT programme, the national-phase route is almost always the right one: it buys time, defers cost, and keeps the UAE on the same clock as the rest of your foreign filings.
The 30-Month PCT Deadline You Cannot Miss
The single most important date is the national-phase deadline. Under both Articles 22 and 39 of the PCT, the UAE sets entry at 30 months from the earliest priority date — not 31. Treat it as a hard wall. Unlike some offices, the Ministry does not offer a routine one-month extension, and there is no cheap reinstatement path if you sleep on it. A missed 30-month date generally forecloses UAE protection for that invention, full stop.
There is a second clock behind the first. After the Ministry accepts the application in form, applicants are typically given 90 days to file the legalized power of attorney and the deed of assignment, and to settle examination fees. Diarize both the 30-month entry and the 90-day housekeeping window the day you instruct local counsel — the second one quietly closes files that entered on time.

File in Arabic: Language and Translation Rules

Arabic is the language of record. You can lodge the application in English to secure the filing date, but a certified Arabic translation of the specification, claims and abstract must follow, generally within the same 90-day window. Budget real time for this: a technical translation of a dense specification is not a same-week task, and a sloppy translation narrows your claims before examination even begins.
In practice, commission the Arabic translation as soon as you decide to enter the Emirates, not after acceptance. The quality of that translation is the quality of your eventual monopoly.
Examination, Publication and What Is Patentable
The UAE is a substantive-examination jurisdiction — it does not simply register whatever is filed. An application moves through formalities, publication, and substantive examination for novelty, inventive step and industrial application before grant. Search and examination are carried out under the Ministry’s cooperation arrangements with established patent offices, so expect scrutiny comparable to other national systems rather than a rubber stamp.
The exclusions track the familiar international pattern. Discoveries, scientific theories and mathematical methods as such, business methods, and inventions whose exploitation would be contrary to public order or morality are not patentable. The law also carves out diagnostic, therapeutic and surgical methods for treating humans or animals, and plant and animal varieties, consistent with most civil-law regimes.
Drawings matter here as much as anywhere. If your application relies on figures, make sure they meet UAE formality expectations before filing — our note on patent drawings in the UAE covers the bilingual labelling point that trips up foreign applicants.
Term, Annuities and What It Costs

A granted UAE patent runs 20 years from the filing date (or, for a national-phase case, from the international filing date), subject to annual maintenance fees. Those annuities begin accruing from the year after filing and are payable during pendency, not just after grant — so the meter is running while you wait for examination. Let one lapse and the application or patent falls away.
Two alternatives are worth knowing. A utility certificate protects incremental inventions for 10 years from filing and is not renewable, which can suit a product with a short commercial life. An industrial design is protected for 20 years from filing. Choose the instrument to match the invention and its market, not out of habit.
- Official fees are tiered and the Ministry periodically updates its schedule — confirm current figures before you budget.
- Local-agent and translation costs are usually the larger line item for a foreign applicant.
- Annuities escalate in later years, so prune portfolios you no longer intend to work.
After the GCC Patent Office Closed: The Gulf Is Nation-by-Nation
This is the fact that reshapes Gulf strategy. The GCC Patent Office in Riyadh stopped accepting new applications on 6 January 2021. Applications filed on or before 5 January 2021 are still being processed, and already-granted GCC patents remain valid across the member states for their term. But there is no longer any way to cover the Gulf with one filing.
So protection is now assembled country by country: the Ministry of Economy in the UAE, the Saudi Authority for Intellectual Property (SAIP) in Saudi Arabia, and the respective national offices in Qatar, Kuwait, Bahrain and Oman. For an applicant who wants the whole region, that means several national or PCT national-phase filings, several sets of annuities, and several deadline calendars — a materially larger docket than the single GCC grant used to require. Plan and budget for that reality from day one.
Where UAE Patents Are Enforced
Infringement and validity are decided in the federal and local civil courts, with specialised commercial circuits in Dubai and Abu Dhabi hearing the bulk of IP disputes. The common-law DIFC and ADGM courts can hear contractual IP matters — licensing and assignment disputes — where the parties have agreed to their jurisdiction, but they are not the forum for a core patent-infringement action against a third party.
If you are building or defending a position in the Emirates, line up local capability early. PerspireIP supports clients on the ground through our United Arab Emirates hub, including patent drawing in Dubai and patent invalidation in Abu Dhabi.
File With Confidence in the Emirates
Entering the UAE after the GCC shutdown means tighter deadlines and more moving parts than most applicants expect. PerspireIP coordinates national-phase entry, Arabic translation, drawings and local representation so nothing slips. Talk to our team before your 30-month date to map the fastest, cleanest route in.
Frequently Asked Questions
Can I still use a single GCC patent to cover the UAE?
No. The GCC Patent Office stopped accepting new applications on 6 January 2021. You now file nationally with the UAE Ministry of Economy, and separately in each other Gulf state you want to cover. Existing GCC patents granted before the closure remain valid.
What is the deadline to enter the UAE national phase from a PCT application?
Thirty months from the earliest priority date, under both Articles 22 and 39 of the PCT. It is not routinely extendable, so treat it as a hard deadline.
Do I have to file in Arabic?
Arabic is the language of record. You can file in English to secure the date, but a certified Arabic translation of the specification, claims and abstract must follow, generally within about 90 days of acceptance.
How long does a UAE patent last?
Twenty years from the filing date (or the international filing date for a national-phase case), subject to annual maintenance fees that start accruing the year after filing and are payable even during pendency.
Does the UAE examine patent applications?
Yes. The UAE conducts substantive examination for novelty, inventive step and industrial application, with search and examination carried out under the Ministry’s cooperation arrangements. It is not a simple registration system.
What is a utility certificate in the UAE?
A utility certificate protects an incremental invention for 10 years from filing and is not renewable. It can be a sensible choice for a product with a shorter commercial life than a full 20-year patent would justify.
