Patent Drawing ยท United Arab Emirates

Patent Drawing in Abu Dhabi.

Patent drawing Abu Dhabi filings go to the federal DIEPD in the same city, in Arabic and English. Numeral-only sheets to PCT Rule 11 from $25 a sheet.

Abu Dhabi is the one city in the Gulf where the applicant and the granting office share a postcode. Every patent drawing Abu Dhabi applicants commission is destined for the federal register administered by the Ministry of Economy and Tourism through its Development of Innovation in the Economy and Patents Department, whose seat is here in the capital, under Federal Decree-Law No. 11 of 2021 and its Executive Regulations. Proximity buys no local rule book — there is no emirate-level patent and no Abu Dhabi drawing standard. What it buys is a short line to the people who will object to your figures, and an appeal route that runs through courts in this emirate.

Who actually examines a patent drawing Abu Dhabi applicants file

The answer is in this city, which is unusual and occasionally useful. Patents, utility certificates and industrial designs in the Emirates are federal. They are granted once, by the Ministry of Economy and Tourism through the Development of Innovation in the Economy and Patents Department, and they take effect across all seven emirates and inside the free zones — including ADGM and Masdar City. There is no Abu Dhabi patent and no Abu Dhabi patent office.

What the emirate does have is its own IP support layer, which Dubai filers do not. The Abu Dhabi Department of Economic Development runs an Intellectual Property Unit, and its Competitiveness Office launched the AD.iP Intellectual Property Excellence Centre to work with researchers and companies across the invention lifecycle. Neither grants rights. Both are worth knowing about if you are filing out of Khalifa University, the Technology Innovation Institute or a Hub71 company, because they shape how local filings get prepared before they reach the Ministry.

The rule set itself is short, and the gap in it matters more than its contents:

  • Federal Decree-Law No. 11 of 2021 — the statute. Article 11 sets the application contents, Article 13 the examination and its deadlines, Article 16 the limits of division, Article 18 the term.
  • Cabinet Decision No. 6 of 2022 — the Executive Regulations, which supply the procedural detail and the periods.
  • The Ministry’s document checklist — not legislation, but the operative list a formalities officer works from.
  • No drawing specification anywhere. No sheet size, no margins, no line weight, no character height, no colour petition.

That last point is the whole design brief. Because nothing local specifies the form of a figure, a patent drawing Abu Dhabi filers submit is judged against the statute, the checklist, and whatever the examiner considers legible. Building to a published external standard removes the discretion from the equation.

The bilingual rule, and why Abu Dhabi’s industries feel it hardest

Article 11(8) of the statute requires the application “and the attachments thereto” to be submitted in both Arabic and English, with the Executive Regulations fixing the period for supplying a missing version. The Ministry’s own patent-registration page says the same operationally: the mandatory documents are the claims, the detailed description and “drawings, if any” — each marked Arabic, English.

Any word inside a figure is text in an attachment. A box label on a control flowchart, a stream name on a process diagram, a units annotation, a layer caption — each one has to exist in both languages, in two sets that must then stay identical for the life of the family.

This is where Abu Dhabi’s filing mix bites harder than Dubai’s. The capital’s patent volume is skewed toward exactly the figure types that are made of words:

  • Energy and petrochemicals. Downstream and gas-processing inventions are disclosed through process flow diagrams and P&IDs, which are almost entirely text — equipment tags, stream labels, operating conditions.
  • Aerospace and advanced manufacturing. Composite layup, tooling and assembly disclosures rely on annotated section and exploded views, where the annotation is doing the explanatory work.
  • Artificial intelligence. A model-architecture invention is disclosed as block diagrams and flowcharts. Every block is a label. This is the worst case for the bilingual rule and the most common filing shape coming out of the capital’s AI institutes.
  • Renewables and water. System-level schematics with named subsystems, again text-heavy by nature.

The fix is the oldest discipline in draughting, and it is worth insisting on: numbers in the figures, words in the description. A figure whose only text is reference numerals, FIG. labels and standard symbols is language-neutral and needs no Arabic twin. The legend that explains numeral 14 lives in the description, which is being translated anyway, by a translator, once. Converting a 30-box AI architecture diagram to numerals is an afternoon of draughting that removes a permanent translation and version-control liability.

For PCT cases WIPO confirms the exposure in advance. The PCT Applicant’s Guide national chapter for the Emirates lists, among the material to be furnished on national-phase entry, a translation of the request, description, claims and expressly “any text matter of drawings.”

Formalities run on a 90-day fuse that ends in waiver

Most offices treat a drawing defect as a correctable irritation. The Emirates treats it as a deadline with a terminal consequence, and that is the single most important procedural fact for anyone managing a file from abroad.

Article 13(1) provides that, once the prescribed fees are paid, the Ministry examines the application and may ask the applicant to fulfil what it deems necessary. If the applicant fails to do so within 90 days of notification, the applicant is deemed to have waived the application. Article 11(9) applies the same 90 days to requested information and additional data. Industrial designs carry the identical fuse under Article 44(1), where non-compliance is treated as relinquishment.

Ninety days is not long once you account for how a notification travels. It issues to the registered agent in Arabic, is reported to foreign counsel, is reported to the client, waits for budget approval, then reaches a draughtsman who has to produce an Arabic-labelled set that someone who reads Arabic must check against a description that may itself need conforming amendment. On a ten-sheet process set that sequence is most of the window before any drawing work starts.

The Ministry’s published service timeline puts the first stage at around seven months from filing, then up to 42 months from payment of the examination fees, then roughly three months from payment of the publication fees to issue. A file that is formally clean on day one spends that time being examined on the merits instead of in correspondence about lettering.

The official fee schedule is the other half of the argument for getting it right once: a new application at AED 1,000 for individuals and AED 2,000 for companies, search and first examination at AED 7,000, and the second and third examinations at AED 5,000 each.

With no local drawing code, build to PCT Rule 11

Since neither the statute nor the regulations specify the form of a drawing, the working answer is to build to the strictest published standard the family will meet anywhere and file that same set everywhere. In practice that is PCT Rule 11, cross-checked against the US rule.

  • PCT Rule 11.5 — “The size of the sheets shall be A4 (29.7 cm x 21 cm).”
  • PCT Rule 11.6(c) — on sheets containing drawings the usable surface “shall not exceed 26.2 cm x 17.0 cm.”
  • PCT Rule 11.13(a) — drawings “shall be executed in durable, black, sufficiently dense and dark, uniformly thick and well-defined, lines and strokes without colorings.”
  • PCT Rule 11.13(h) — “The height of the numbers and letters shall not be less than 0.32 cm” — verify after scaling, not before.
  • 37 CFR 1.84(g) — margins of at least 2.5 cm top, 2.5 cm left, 1.5 cm right and 1.0 cm bottom, leaving a sight no greater than 17.0 cm by 26.2 cm on A4 sheets.

Colour is a trap here, because two of the three regimes have moved and the Emirates has not. In a US utility application colour needs a granted petition under 37 CFR 1.84(a)(2) with the fee under 1.17(h); in a US design application it needs no petition. At the European Patent Office, Rule 46 EPC was deleted with effect from 1 February 2023 and the presentation requirements moved into a Decision of the President, and since 1 October 2025 the EPO accepts drawings filed electronically in colour or greyscale.

None of that reaches the PCT, where Rule 11.13(a) still requires black lines without colorings, and none of it reaches the Emirates, which has no colour provision to rely on at all. A patent drawing Abu Dhabi filers submit should be black line work, with any colour-dependent information carried in hatching, stippling or a numeral-keyed legend.

Routes into the Emirates, and the Gulf route that closed

Abu Dhabi portfolios are rarely UAE-only; they are Gulf portfolios, and the arithmetic of Gulf filing changed permanently five years ago.

The GCC Patent Office stopped accepting new applications on 6 January 2021. The single regional filing that once covered all six Gulf Cooperation Council states is gone for new cases. Coverage is now assembled country by country: the Ministry of Economy and Tourism here, SAIP in Saudi Arabia, the Ministry of Commerce and Industry in Qatar. Three countries now means three files, three agents and three formalities checks — which is exactly why one reusable master set pays for itself.

Three routes remain into the Emirates:

  1. Direct national filing at the Ministry with the full bilingual document set.
  2. Paris Convention filing within the 12-month priority period set by Article 12(2).
  3. PCT national-phase entry at 30 months from the priority date, under both PCT Article 22(1) and Article 39(1)(a) — 30, not the 31 months several European states allow — with a translation into Arabic or English that expressly includes any text matter of the drawings.

What is not available: the Emirates is not a contracting state of the European Patent Convention and there is no validation agreement, so a granted European patent has no route to effect here. A docket that treats the UAE as an EPC extension state produces a lost deadline, not a formalities objection.

Industrial designs are a separate filing with different clocks worth docketing carefully: a six-month priority period under Article 42(2) rather than twelve, a one-year grace period for the applicant’s own disclosure under Article 43, more than one design per application only within the same international class under Article 41, and a protection term of 20 years from the filing date under Article 45(1) — generous by international standards.

Where an Abu Dhabi dispute is heard — and the appeal route unique to this emirate

The formalities officer is not the last reader of your figures. Two forums in this city are, and they work in different languages under different law.

Onshore, infringement is a civil action in the Abu Dhabi Courts of First Instance administered by the Abu Dhabi Judicial Department, with appeal to the Court of Appeal and then the Abu Dhabi Court of Cassation. Proceedings are in Arabic. There is no specialised patent court, and the court typically appoints a technical expert whose report tends to decide the case. Validity is raised as a defence or counterclaim inside that action rather than in separate revocation proceedings.

In the free zone, the Abu Dhabi Global Market operates English-language common-law courts with a Court of First Instance and a Court of Appeal. ADGM is distinctive even by regional standards: under Article 1(1) of its Application of English Law Regulations 2015, English common law applies directly and forms part of ADGM law, including English and Welsh precedent, without codification or translation. That makes ADGM the natural forum for licence, assignment and development-agreement disputes about patents — but ADGM does not grant or cancel federal patents.

Then there is the route that belongs to Abu Dhabi specifically. An administrative decision of the Ministry — including a refusal, which may rest on a formalities failure — goes first to a grievances committee and then to the competent federal court, with the Abu Dhabi Federal Court of Appeal designated for IP administrative appeals. If your application dies under Article 13(1), the appeal is heard in this emirate regardless of where in the Emirates you filed from.

The evidential consequence is concrete. Where the Arabic and English figure sets diverge — a label translated loosely, a numeral that moved during a redraw, a view regenerated at a different scale — you have handed the other side a discrepancy inside the granted document, in a forum that leans heavily on expert reports. Numeral-only figures remove the discrepancy at source, because nothing in them is left to translate differently.

How PerspireIP delivers patent drawing Abu Dhabi work

We draught for the whole family, not for one office, and in the Gulf that means designing the set so the language requirement never applies to it.

  1. Numeral-only by default. Every figure is delivered with reference numerals, FIG. labels and standard symbols only, with a numeral schedule you can drop into the description. Article 11(8) then costs you nothing.
  2. Built to PCT Rule 11 and 37 CFR 1.84. A4, usable surface within 26.2 by 17.0 cm, black uniform line work, characters at least 0.32 cm high at final size.
  3. Division-proofed. We flag embodiments that exist only as unlabelled detail, because Article 16(1) limits every later divisional to what the original description or drawings stipulate.
  4. Matched Arabic pairs when they are genuinely needed. Some P&IDs and control schematics cannot be reduced to numerals. Where that is the case we produce both sets under one version and keep them reconciled.
  5. Design sets to 37 CFR 1.152. Sufficient views for a complete disclosure, claimed and unclaimed matter distinguished, docketed to the six-month Article 42(2) period.
  6. $25 per sheet, three to five business days, with a fixed quote inside one business day.

Most of our Abu Dhabi instructions arrive as CAD exports, process diagrams or architecture block diagrams from energy, aerospace and AI teams, often with a Saudi and Qatari filing already planned. Those are the files where one language-neutral master set turns three national filings into a copying exercise.

Frequently Asked Questions

Which office examines a patent drawing Abu Dhabi applicants file?

The federal Ministry of Economy and Tourism, through its Development in the Economy and Patents Department, whose seat is in Abu Dhabi. Patents in the Emirates are granted once at federal level and take effect across all seven emirates and inside the free zones. There is no emirate-level patent office and no Abu Dhabi patent.

Do the drawings have to be in Arabic as well as English?

Any text inside a figure does. Article 11(8) of Federal Decree-Law No. 11 of 2021 requires the application and its attachments in both Arabic and English, and the Ministry’s own checklist lists drawings as Arabic and English. A figure containing only reference numerals and FIG. labels has no text to translate, which is why we draught numeral-only sets.

What happens if the Ministry objects to my figures?

Article 13(1) gives 90 days from notification to fulfil what the Ministry requires, and missing it means you are deemed to have waived the application. Industrial designs carry the same consequence under Article 44(1). There is no extension provision aimed at formalities responses.

Can I validate a European patent in Abu Dhabi?

No. The Emirates is not a contracting state of the European Patent Convention and there is no validation agreement, so a granted European patent cannot take effect here. The routes in are a direct national filing, a Paris Convention filing within 12 months under Article 12(2), or PCT national-phase entry at 30 months from the priority date.

Is the GCC Patent Office still available for Gulf coverage?

No. It stopped accepting new applications on 6 January 2021. UAE, Saudi and Qatari protection are now three separate national filings with three sets of formalities, which is the strongest practical argument for one reusable, language-neutral master drawing set.

Would an Abu Dhabi patent dispute go to the ADGM courts?

Only a contractual one. ADGM’s English-language courts apply English common law directly under Article 1(1) of the Application of English Law Regulations 2015 and are well suited to licence and assignment disputes, but they do not grant or cancel federal patents. Infringement is heard onshore in the Abu Dhabi courts under the Judicial Department, in Arabic, usually with a court-appointed technical expert.

How long does the UAE patent process take?

The Ministry’s published service timeline indicates roughly seven months from filing to the first stage, then up to 42 months from payment of the examination fees, then around three months from payment of the publication fees to issue. Official fees are AED 1,000 for individuals or AED 2,000 for companies to file, AED 7,000 for search and first examination, and AED 5,000 for each of the second and third examinations.
