Why patent drawing Mannheim filings answer to three rulebooks at once

A Mannheim invention rarely travels on one route. The German Patent and Trade Mark Office (Deutsches Patent- und Markenamt, DPMA) grants national patents and utility models. Germany has been a European Patent Convention state since the Convention entered into force, so most commercially serious cases are also prosecuted at the EPO. Add a PCT application for the US and Asian markets and one invention carries its figures through three formalities regimes before anyone argues about validity.

The regimes agree on most things, which is exactly what makes the gaps dangerous. Sheet size, margins, line weight, view numbering and reference-character height are broadly harmonised. What diverges is narrow: what colour is allowed, whether a photograph is acceptable, and how much text may sit inside a figure. Those are the divergences that produce a formalities objection months after filing, when the drawings have already been cited in the description and the claims.

For the DPMA specifically, the formal requirements for the application documents โ€” drawings included โ€” are set by the Patentverordnung, the German Patent Ordinance, rather than by the Patent Act itself. National filings are made in German, and while reference numerals travel across languages without difficulty, any word left inside a figure will not.

Where a Mannheim patent dispute is actually heard

Mannheim’s reputation rests on the patent chambers of the Landgericht Mannheim, which together with Munich and Dรผsseldorf handle the bulk of German patent-infringement litigation. Appeals from Mannheim go to the Oberlandesgericht Karlsruhe, not to Dรผsseldorf โ€” a distinction that matters when you are reading case law to predict how a figure will be construed. Further appeals on points of law reach the Bundesgerichtshof, also seated in Karlsruhe, whose Tenth Civil Senate hears patent matters.

Validity is somewhere else entirely. German revocation actions and appeals from DPMA decisions go to the Bundespatentgericht, the Federal Patent Court, which sits in Munich โ€” not in Mannheim and not in Karlsruhe. A Mannheim defendant attacking a patent is therefore litigating in two cities at once.

Since 1 June 2023 the Unified Patent Court has added a further forum. Germany hosts four UPC local divisions โ€” Munich, Mannheim, Dรผsseldorf and Hamburg โ€” and the Mannheim division draws the region’s automotive and engineering disputes. The UPC decides infringement and validity together, so the bifurcation habit below does not apply there.

Bifurcation, and why your figures get read by two different benches

German national litigation splits infringement from validity. The Landgericht Mannheim decides whether the accused product falls within the claim; it does not revoke the patent. The Bundespatentgericht decides validity on a slower clock. The interval between an infringement judgment and a validity ruling is the well-known injunction gap, and it is why a Mannheim injunction is commercially serious.

The drawing consequence is specific. In an infringement action the figures are read expansively, as support for what the claim covers. In the parallel nullity action the same figures are read as disclosure โ€” what did this application actually teach on its filing date? A figure that is generous enough to capture an infringer and specific enough to survive an added-matter attack is not something you assemble after the fact.

That is also the practical reason to keep figures consistent across the national, European and UPC copies of a case. Where the same invention is enforced at the Landgericht and attacked at the Federal Patent Court, any drift between the drawing sets becomes an argument the other side did not have to construct.

The DPMA route and the Gebrauchsmuster, where drawings do more work

Germany keeps a second-tier right the EPC has no equivalent of: the Gebrauchsmuster, or utility model. It is registered without substantive examination, runs to a maximum of ten years rather than twenty, and can be branched off a pending patent application. Because nobody examines it before registration, the disclosure as filed is all the protection there is.

That makes the figures load-bearing. A utility model asserted in Mannheim will be met with a cancellation request, and its validity will be judged on what the drawings and description disclosed on day one. Thin or ambiguous figures that an examiner would have queried in a patent application simply go unchallenged into registration โ€” and then fail when it matters.

Two further points catch foreign applicants. Utility model protection is not available for processes, so a method drawn as a flow diagram cannot be rescued that way. And the German-language requirement applies to the application documents, so any figure text has to be prepared in German rather than translated later.

What Mannheim’s industries actually need drawn

The Rhine-Neckar filing profile is unusually mechanical for a modern European region, and it shapes the drawing brief.

  • Powertrain and commercial vehicles. Mannheim’s engine manufacturing runs back to Benz, and heavy-duty powertrain work still drives filings. These are sectional-view cases: cut planes, hatching that distinguishes materials, and assemblies that must read clearly at two-thirds reduction.
  • Agricultural machinery. John Deere’s European manufacturing base in Mannheim generates large-assembly filings where exploded views and consistent reference numerals across twenty-plus figures matter more than artistry.
  • Diagnostics and life sciences. Roche Diagnostics’ Mannheim site puts analyser hardware, consumables and assay workflows into the local filing mix โ€” cases that mix mechanical figures with data plots and, occasionally, images no line drawing can replace.
  • Chemicals. BASF’s Ludwigshafen complex sits directly across the Rhine. Chemical cases route formulae and process diagrams differently from mechanical ones, and getting that routing wrong is a formalities objection rather than a drafting preference.
  • Enterprise software and automation. SAP at Walldorf and the region’s automation suppliers file flowchart-led cases where the figures carry the technical-character argument under the EPO’s established approach to computer-implemented inventions.

Colour, photographs and text inside a figure: two European changes to know

Two recent European developments change long-standing advice. First, the EPO began accepting colour drawings on 1 October 2025, ending the practice of converting everything to black and white before filing. Colour is now a genuine option for a European case โ€” but the national and PCT copies of the same invention may still not accept it, so the monochrome master remains worth keeping.

Second, Rule 46 EPC โ€” the old ‘form of drawings’ provision that a great deal of published guidance still cites โ€” was deleted by decision CA/D 10/22 with effect from 1 February 2023. The EPO’s own page for the rule now reads simply as deleted. The presentation requirements sit in Rule 49 EPC and in the Guidelines for Examination, Part A, Chapter IX. Citing Rule 46 in a response in 2026 signals that the authority behind it was never checked.

Text inside figures remains the most common avoidable error on the international copy. PCT Rule 11.11 permits no text matter in drawings except a single word or words where absolutely indispensable, with a narrow allowance of short catchwords in flow sheet and circuit diagrams. German-language labels scattered through a figure will not survive that rule, and stripping them at the last minute is how reference numerals get orphaned.
