IP Litigation
Information is what is important for every litigation support and concept validation. PerspireIP provide all sort of priorart searches such as invalidation search, infringement search, etc. Our litigation support includes following options:
Invalidation Search
Invalidity or validity searches are comprehensive searches which are performed mostly during a patent infringement law suit, to prove a granted patent invalid and also these searches are performed during licensing to assert the claims of the target patent is valid or not. We systematically evaluate and analyse the queries raised by the patent examiner during the prosecution of a patent application, by conducting a thorough analysis of the prosecution history at initial stages of an Invalidation search. The in-depth analysis of the file-wrapper, provides a clear-cut idea of novelty within the patent.
Our technology expertise accumulated after years of relevant experience, and superior understanding of the patent laws helps us understand the context and merits/demerits of every case leading to targeted rebuttal reports and wins in complex technology disputes

Our Patent databases include Thomson Innovation, Orbit (from QuestelTM) and Total Patent (from LexisNexisTM), Google Patents, Espacenet, USPTO, and other national. Non-patent databases includes such as IP.com, Google Scholar, IEEE Xplore, CiteSeer, ACM Library, Wiley’s Library, etc.
Infringement Search
A Patent Infringement Search determines whether your proposed or existing product/invention infringes on any in-force patent claims. It makes you aware of the potential infringement and helps the client make the appropriate business decision. This further involves Patent Invalidity Search on the patent in question, to initiate design-around activities, or to consider licensing the technology at issue.
We take a lead in such searches as our technical experts work in close association with the experienced Patent Attorneys.
Claim Construction
Markman hearing, or a claim construction hearing, is a pre-trial hearing during which a judge examines evidence from all parties on the meanings of relevant keywords used in a patent claim. Our in-house team of technology specialists works closely with subject matter experts and expert witnesses to provide a clear interpretation of the key terms of the disputed claim in light of the specification, file history and the case context to bolster the client’s infringement/rebuttal arguments.
