A Notice of Draftsperson’s Patent Drawing Review almost never says your invention was drawn badly. It says the sheet was wrong. USPTO drawing margins are specified to the millimetre in 37 CFR 1.84(g), and a CAD export that defaults to a 20 mm border on the right-hand side breaks the rule before a single line of the invention is examined. That is a correction cycle you paid for and did not need. This guide sets out the exact figures, the sight dimensions they produce on both permitted sheet sizes, what may and may not sit inside the blank border, and where the PCT and the EPO diverge from US practice.
What the USPTO Drawing Margins Rule Actually Says

The controlling text is 37 CFR 1.84(g). It is short, and it is worth reading in the original rather than in a summary, because every number in it is operative: “The sheets must not contain frames around the sight (i.e., the usable surface), but should have scan target points (i.e., cross-hairs) printed on two catercorner margin corners. Each sheet must include a top margin of at least 2.5 cm. (1 inch), a left side margin of at least 2.5 cm. (1 inch), a right side margin of at least 1.5 cm. (5/8 inch), and a bottom margin of at least 1.0 cm. (3/8 inch)…”
So the four figures are these, and they are minimums rather than targets:
- Top: at least 2.5 cm (1 inch)
- Left: at least 2.5 cm (1 inch)
- Right: at least 1.5 cm (5/8 inch)
- Bottom: at least 1.0 cm (3/8 inch)
Two details in that sentence catch more filings than the measurements do. The first is the prohibition on frames. A border box drawn around the working area — the kind almost every CAD template ships with, often carrying a title block — is not permitted. The second is the instruction about scan target points: cross-hairs on two catercorner (diagonally opposite) margin corners, which exist so the Office’s scanners can register the sheet.
Note the asymmetry. The left margin is two-thirds wider than the right. That is deliberate, and it is a hangover from paper filing, where sheets were bound along the left edge. Symmetrical margins are the single most common way a draftsperson’s review is triggered, because a designer who is told “1 inch all round” has technically satisfied the minimums but has usually done it by shrinking the drawing.
Sheet Size Comes First, Under 37 CFR 1.84(f)
You cannot apply the USPTO drawing margins without first fixing the sheet. Paragraph (f) allows exactly two sizes: “All drawing sheets in an application must be the same size. One of the shorter sides of the sheet is regarded as its top. The size of the sheets on which drawings are made must be: (1) 21.0 cm. by 29.7 cm. (DIN size A4), or (2) 21.6 cm. by 27.9 cm. (8½ by 11 inches).”
Three consequences follow, and each one is a real objection we see:
- No mixing. An application cannot contain some A4 sheets and some letter sheets. This happens constantly when a US firm adds two figures to a set originally prepared for a European or PCT filing.
- No landscape sheets. Because a shorter side is the top, the sheet is always portrait. Wide figures are rotated on the sheet, not the sheet on the figure — see 37 CFR 1.84(i), which requires that all views on a sheet stand in the same direction so the sheet can be read upright.
- No other sizes. Tabloid, A3 and legal are not options, however much a foldout would help a large assembly. A big drawing is split across sheets as partial views.
If you are filing at the USPTO only, letter-size is the pragmatic choice because it prints correctly in the US without scaling. If the same figures are going to the PCT or the EPO, use A4 from the start. Rescaling a finished sheet set later is where reference numerals drift out of position and line weights fall below the reproduction threshold.
The Sight Is the Real Constraint, Not the Border

The rule does not stop at the four measurements. It states the usable area they leave behind, and this is the number your drafting template should actually be built around. The same sentence of 1.84(g) continues: “…thereby leaving a sight no greater than 17.0 cm. by 26.2 cm. on 21.0 cm. by 29.7 cm. (DIN size A4) drawing sheets, and a sight no greater than 17.6 cm. by 24.4 cm. (6 15/16 by 9 5/8 inches) on 21.6 cm. by 27.9 cm. (8½ by 11 inch) drawing sheets.”
Set those side by side and the practical problem becomes obvious:
- A4: sight of 17.0 cm wide × 26.2 cm tall
- Letter: sight of 17.6 cm wide × 24.4 cm tall
The letter sheet is wider but nearly 2 cm shorter. A tall figure — a flowchart with a dozen sequential steps, an elevation of a mast or a column — that fits an A4 sight will overrun a letter sight, and the usual reaction is to scale it down until it fits. That is how you end up failing a different part of the rule entirely, because 1.84(l) requires lines to be durable and clean enough to reproduce, and 1.84(p)(3) sets a minimum character height of 0.32 cm for numbers and letters.
The right move is to split the figure across two sheets as partial views rather than shrink it. Under 37 CFR 1.84(u)(1), partial views intended to form one complete view are identified by the same number followed by a capital letter — Fig. 4A and Fig. 4B — which keeps the disclosure intact and the text legible. What May Sit Inside the Margin, and What May Not
This is where the rule surprises people, because the answer is not “nothing”. Two different provisions point in opposite directions, and confusing them produces an objection either way.
Identifying information belongs in the top margin. 37 CFR 1.84(c) provides that identifying indicia should be provided, and if provided should include the title of the invention, the inventor’s name, and the application number — placed on the front of each sheet, within the top margin.
Sheet numbers belong outside it. 37 CFR 1.84(t) is explicit: “The sheets of drawings should be numbered in consecutive Arabic numerals, starting with 1, within the sight as defined in paragraph (g) of this section. These numbers, if present, must be placed in the middle of the top of the sheet, but not in the margin.”
So on a compliant sheet, the top of the page carries the title and inventor in the blank border, and the sheet number sits just below the margin line, centred, inside the drawing area. Get these two the wrong way round and both checks fail at once. The convention of writing “Sheet 2 of 7” in a corner title block breaks the rule twice over: wrong position, and a title block is a frame.
View numbering is a separate sequence again. Under 1.84(u)(1) views are numbered in consecutive Arabic numerals starting with 1, independent of the sheet numbering. Five figures spread over three sheets means Figs. 1 through 5 and sheets 1 through 3, and the two sets of numbers have no relationship to each other.
Where the PCT and the EPO Match, and Where They Diverge

If a family is heading abroad, the good news is that the USPTO drawing margins were harmonised with the international standard. PCT Rule 11.6(b) sets the margins for sheets containing drawings at a minimum of 2.5 cm top, 2.5 cm left, 1.5 cm right and 1.0 cm bottom, with a usable surface not exceeding 26.2 cm by 17.0 cm — the A4 sight, to the millimetre. PCT Rule 11.5 fixes the sheet at A4.
One difference matters. PCT Rule 11.7 requires the sheets of an international application to be numbered consecutively in the centre of the top or bottom, outside the margins. That is the opposite of 37 CFR 1.84(t), which puts the sheet number inside the sight. A drawing set that satisfies one will be marked on the other, which is why we keep the sheet number on a separate layer and move it at export.
Europe has gone somewhere else entirely. Rule 46 EPC, the old provision headed “Form of the drawings”, was deleted with effect from 1 February 2023, along with most of Rule 49 EPC, as part of the EPO’s digital-transformation package. The detailed presentation requirements no longer live in the Rules at all; they are now prescribed by a decision of the President of the EPO, with the general framework left in Rule 49 EPC and the working guidance in the Guidelines for Examination at Part A, Chapter IX.
The practical warning is about stale checklists. A great many drawing briefs, template packs and firm precedents still cite Rule 46 EPC as live authority for European margins. It is not. If a supplier hands you a specification whose European section is anchored to Rule 46, that specification predates February 2023 and probably also predates the EPO’s acceptance of colour drawings and photographs, which took effect on 1 October 2025. Design Applications: 37 CFR 1.152 Sits on Top of the Sheet Rules
A design application does not get its own sheet geometry. 37 CFR 1.152 opens by folding the utility rule straight in: “The design must be represented by a drawing that complies with the requirements of § 1.84 and must contain a sufficient number of views to constitute a complete disclosure of the appearance of the design.”
Everything above therefore applies unchanged — same two sheet sizes, same four minimum margins, same sights, same numbering split. What 1.152 adds is a layer of substantive requirements about the marks inside the sight:
- Appropriate and adequate surface shading should be used to show the character or contour of the surfaces represented.
- Solid black surface shading is not permitted except when used to represent the colour black as well as colour contrast.
- Broken lines may be used to show visible environmental structure, but may not be used to show hidden planes and surfaces that cannot be seen through opaque materials.
- Alternate positions of a design component, shown by full and broken lines in the same view, are not permitted.
- Photographs and ink drawings may not be combined as formal drawings in one application.
The interaction to watch is between shading and the sight. Surface shading eats resolution. A design view scaled down to fit a letter-size sight often loses the contour information the shading was there to convey, and an examiner cannot tell a curved surface from a flat one. Design cases are the strongest argument for choosing the sheet size deliberately at the outset rather than accepting a template default.
Seven Checks Before the Sheets Go Out
These take a couple of minutes per set and remove most of what a draftsperson’s review would otherwise catch. Six of the seven are about the USPTO drawing margins and the geometry they define.
- One sheet size throughout. Confirm every sheet is A4 or every sheet is letter, including figures added late in drafting.
- Margins measured, not assumed. Check the actual exported PDF at 100%, not the CAD workspace. Top 2.5 cm, left 2.5 cm, right 1.5 cm, bottom 1.0 cm, minimum.
- No frame anywhere. Delete border boxes and title blocks. Keep the two catercorner cross-hairs.
- Nothing overruns the sight. 17.0 × 26.2 cm on A4, 17.6 × 24.4 cm on letter. Split tall figures into partial views rather than scaling them down.
- Title, inventor and application number in the top margin, per 1.84(c).
- Sheet numbers centred at the top but below the margin line, inside the sight, per 1.84(t) — and moved outside the margin if the same set is filed under the PCT.
- Figure numbers run independently of sheet numbers, with partial views lettered 4A, 4B and so on.
If two or more of these come back uncertain, the set is not ready to file. A drawing objection is rarely fatal, but it consumes a response cycle and attorney time that a priority-year strategy usually cannot spare.
