Most work on plant biotech patents now runs through utility patents and plant variety certificates instead, and choosing between the three routes at the wrong moment is expensive to undo. What Is a Plant Patent?
A plant patent is a specialized form of patent protection granted for the invention or discovery and asexual reproduction of any distinct and new variety of plant. Plant patents are governed by 35 U.S.C. 161-164 and cover plants that have been asexually reproduced — meaning reproduced through means other than seeds, such as cuttings, grafting, budding, or tissue culture. Examples of plants protected by plant patents include new varieties of roses, ornamental shrubs, fruit trees, and other horticultural plants.
Plant patents are distinct from utility patents covering plant-related biotechnology and from Plant Variety Protection (PVP) certificates under the Plant Variety Protection Act. Understanding which form of protection is appropriate for your particular plant innovation is the first step in developing an effective IP strategy.
What Can Be Protected by a Plant Patent?
To qualify for a plant patent, the plant variety must meet several requirements. The plant must be distinct — clearly distinguishable from existing known varieties by one or more characteristics such as color, shape, fragrance, disease resistance, or yield. It must be new — not sold or released for more than one year before the filing date in the United States or before the filing date in any other country.
It must have been asexually reproduced — the applicant must have actually reproduced the plant asexually to prove it can be reproduced consistently and to confirm that the distinctive characteristics are stable and heritable. Finally, tuber-propagated plants (like potatoes) and plants found in an uncultivated state are specifically excluded from plant patent protection.
Plant Patents vs Utility Patents for Plant Innovations
While plant patents protect specific asexually reproduced varieties, utility patents can protect broader aspects of plant-related innovations. A utility patent might cover a specific gene or genetic modification, a method of breeding plants with certain characteristics, a method of treating plants to achieve certain results, or plant products such as extracted compounds or derived materials. For genetically modified plants, a utility patent is typically the more appropriate form of protection because it covers the underlying biotechnology regardless of the specific plant variety.
Plant Variety Protection vs Plant Patents
The Plant Variety Protection Act (PVPA) provides an alternative form of protection administered by the U.S. Department of Agriculture rather than the USPTO. PVP certificates protect sexually reproduced or tuber-propagated plant varieties (the types excluded from plant patent protection) and last for 20 years (25 years for trees and vines). Key differences include the research exemption (researchers can use PVP-protected varieties for experimental purposes, while plant patents provide no such exemption) and the saved seed exemption (farmers can save seed from PVP-protected varieties under certain conditions, a right that does not exist under patent protection).
The Plant Patent Application Process
Filing a plant patent application requires specific elements that differ from a standard utility application. The application must include a complete botanical description of the plant that distinguishes it from the closest related known variety. This description must cover all distinctive characteristics in botanical terms, including growth characteristics, leaf shape and color, flower characteristics, fruit characteristics (if applicable), disease resistance, and any other distinguishing features. The application must also include a statement that the applicant invented or discovered and asexually reproduced the plant variety and a declaration that the variety has not been previously patented or published.
- Drawings or photographs are required and must show the plant in color to the extent color is a distinguishing characteristic.

Examination of Plant Patent Applications
Plant patent applications are examined by the USPTO’s specialized Plant Patent Group. The examination focuses on whether the variety is new and distinct compared to known varieties, whether the description is adequate to distinguish the variety from existing plants, and whether the asexual reproduction requirement has been met. Examination can be challenging because the examiner must compare your plant against a vast body of existing horticultural and botanical knowledge, including commercial nursery catalogs, botanical publications, and previously issued plant patents.
Duration and Rights Under a Plant Patent
A plant patent grants its owner the right to exclude others from asexually reproducing the plant and from using, offering for sale, or selling the plant so reproduced, or any of its parts, in the United States. Plant patents are valid for 20 years from the filing date. Unlike utility patents, plant patents do not require maintenance fees. The protection covers any asexual reproduction of the patented variety, even if the reproducer was unaware of the patent.

Plant Biotech Patents and the Three US Protection Routes
The United States is unusual in offering three overlapping rights over plant material, administered by two different agencies under two different statutes. They are not alternatives to be picked casually; each has a different subject matter, a different scope and a different enforcement profile.
- The plant patent, 35 U.S.C. 161. Covers a distinct and new variety of plant that has been invented or discovered and asexually reproduced — cuttings, grafting, budding, division. Tuber-propagated plants and plants found in an uncultivated state are excluded. Under 37 CFR 1.164 the application contains a single claim, directed to the plant as described and illustrated. Term is twenty years from the filing date, and no maintenance fees are due.
- The utility patent, 35 U.S.C. 101. Covers plants, seeds, plant parts, genetic constructs, transformation methods and breeding methods, with the ordinary requirements of novelty, non-obviousness, written description and enablement, and with as many claims as the case supports. This is where genuine plant biotech patents live.
- The plant variety protection certificate, 7 U.S.C. 2321 et seq. Issued by the USDA Plant Variety Protection Office, not the USPTO, for sexually reproduced and tuber-propagated varieties. Requires the variety to be new, distinct, uniform and stable, and carries statutory research and farmer-saved-seed exemptions that patents do not.
That utility patents are available for plants at all was settled by the Supreme Court in J.E.M. Ag Supply v. Pioneer Hi-Bred International in 2001, which held that neither the Plant Patent Act nor the Plant Variety Protection Act limits the reach of 35 U.S.C. 101 over living plant subject matter. The Board of Patent Appeals had reached the same conclusion in Ex parte Hibberd in 1985. Protection can therefore be layered: a utility patent and a PVP certificate may cover the same variety at the same time.
What the Disclosure Has to Do in a Plant Case
Plant applications fail on disclosure more often than on prior art, and the disclosure rules differ sharply between the three routes.
Plant patents relax enablement and tighten description. Because a plant cannot be reproduced from a written recipe, 35 U.S.C. 162 provides that a plant patent claim will not be declared invalid for non-compliance with 112 if the description is as complete as is reasonably possible. The burden shifts onto the botanical description and the drawings: 37 CFR 1.165 requires plant patent drawings to be artistically and competently executed and expressly permits them in colour where colour is a distinguishing characteristic of the variety, which is unusual in US patent practice.
Utility claims to biotechnology carry the full 112 burden. Written description and enablement are both live, and they fail differently. A genus claim to a class of transformed plants supported by a single working example runs into the possession requirement of Ariad Pharmaceuticals v. Eli Lilly; a claim requiring undue experimentation to practise across its full scope runs into enablement. Sequence disclosures must comply with the WIPO Standard ST.26 sequence listing requirements, which replaced the older ST.25 standard for applications filed from 1 July 2022.
Deposits substitute for description where words cannot carry it. Where the biological material is not otherwise available or reproducibly obtainable, a deposit under the Budapest Treaty made with an International Depositary Authority, in accordance with 37 CFR 1.801 to 1.809, satisfies the requirement. The deposit has to be in place and correctly referenced; discovering the gap during prosecution is far more difficult to remedy than making the deposit before filing.
Filing Abroad: UPOV, the EPC Exclusion and Practical Sequencing
Nothing about the American three-route structure carries over to the rest of the world, and the mismatch catches breeders who assume a US strategy travels.
Europe excludes plant varieties from patentability. Article 53(b) EPC bars European patents for plant and animal varieties and for essentially biological processes for the production of plants or animals. The exclusion is variety-specific: a claim covering plants that is not confined to a particular variety can remain patentable, which is why claim drafting for Europe looks materially different from the equivalent US claim. Variety rights themselves are obtained through the Community Plant Variety Office as an EU-wide right, or nationally.
UPOV is the international framework for variety rights. The International Union for the Protection of New Varieties of Plants administers the 1961 Convention as revised, most significantly in 1991. The US PVP system and the European Community system are both built on the UPOV distinctness, uniformity and stability test, so the technical dossier prepared for one is largely reusable for the others — a genuine efficiency that is frequently missed.
Two sequencing rules matter more than anything else in a plant programme. First, commercial sale or distribution of the variety starts clocks in every system, and they are not the same clocks: the US grace period under 35 U.S.C. 102(b)(1) runs one year from the inventor’s own disclosure, while most other jurisdictions have no equivalent, and the PVP novelty rules have their own separate sale-based bars. Second, field trials, catalogue listings and variety-registration filings can themselves be disclosures. Decide the filing strategy for plant biotech patents before the first plot goes public, not after.
