Patent Drawing Line Thickness: 7 Rules to Avoid Objections

Nobody files a patent application worrying about how thick the lines are. Then the notice arrives: the drawings are objected to as informal, and the figures you exported at midnight are suddenly a two-month detour. Patent drawing line thickness is the least glamorous requirement in the whole formalities checklist, and it fails more applications than shading, margins and legends combined – because it is the one requirement a CAD export can quietly destroy without changing anything you can see on screen. The rule is not really about millimetres. It is about whether every stroke still reads after the office shrinks your sheet.

Why Patent Drawing Line Thickness Is Judged After Reduction, Not On Screen

Every drawing rule that touches line weight shares one assumption: your figure will be reduced before anyone else sees it. The USPTO, WIPO and the EPO all publish drawings smaller than filed, and all three write their requirements against that reduced version rather than the file you uploaded. That single fact explains why a figure can look immaculate in your viewer and still draw an objection.

So the practical question is never how many millimetres. It is whether a stroke that is currently one pixel wide will still be a visible, continuous, black line after a linear reduction to two-thirds and a trip through a scanner. Hairlines, anti-aliased edges and 40% grey construction lines all fail that test while looking perfectly fine at 100% zoom.

It also explains the remedy. You do not fix line weight by nudging a slider until an examiner stops complaining; you fix it by drawing to a standard that survives the reduction with margin to spare. The rest of this article is the standard, rule by rule, for the three routes most applicants actually use.

Rule 1: What 37 CFR 1.84(l) Requires of Every Line, Number and Letter

The governing US provision is 37 CFR 1.84, paragraph (l), headed Character of lines, numbers, and letters. Its operative sentence is short and absolute: “Every line, number, and letter must be durable, clean, black (except for color drawings), sufficiently dense and dark, and uniformly thick and well-defined.”

Read the adjectives as a checklist rather than as prose, because that is how a draftsperson in the Office of Patent Application Processing reads them. Five separate qualities are being demanded, and a figure only has to fail one of them to be objected to.

  • Durable – the mark must not fade, smear or degrade on handling or scanning.
  • Clean – no stray marks, no ghosting, no residue from erased construction geometry.
  • Black – the default is black ink; colour is available only through the separate petition route in 37 CFR 1.84(a)(2).
  • Sufficiently dense and dark – this is the one that kills grey CAD output, because a 50% grey line is neither dense nor dark.
  • Uniformly thick and well-defined – a single stroke must not taper, thin out at curves, or blur at its edges.

Paragraph (l) then adds the reproduction clause that governs everything else: the weight of all lines and letters must be heavy enough to permit adequate reproduction, and that requirement applies to all lines however fine, to shading, and to lines representing cut surfaces in sectional views. In other words, the delicate strokes are not exempt because they are delicate. A hatching line in a section view is held to the same standard as the outline of the part.

Notice what paragraph (l) never does: it never states a number. Patent drawing line thickness is regulated by outcome rather than by dimension, which is why two figures with identical pen settings can be treated differently. The examiner is not measuring your strokes; the draftsperson is asking whether they reproduced.

Rule 2: The Two-Thirds Reduction Test Hidden in 37 CFR 1.84(k)

Line weight cannot be assessed without scale, which is why paragraph (k) matters as much as paragraph (l). It requires that “the scale to which a drawing is made must be large enough to show the mechanism without crowding when the drawing is reduced in size to two-thirds in reproduction.”

Two-thirds is the number to design against. If two adjacent strokes merge, or a reference numeral fills in, at 67% linear scale, the figure does not comply – regardless of how carefully you set the pen weights. The usual cure is not thinner lines but fewer elements per view: split the crowded figure into two, or add an enlarged detail view.

The same paragraph bans the obvious workaround. Notations such as “actual size” or “scale 1/2” are not permitted on the drawings, because they lose their meaning the moment the sheet is reproduced at a different format. If scale genuinely matters to your disclosure, it belongs in the specification, not lettered onto the sheet.

Rule 3: When Different Line Weights Are Allowed – and When They Are Mandatory

Practitioners often read “uniformly thick” as a ban on varying line weight across a figure. It is not. Paragraph (l) expressly permits lines and strokes of different thicknesses in the same drawing where the different thicknesses have a different meaning. Uniformity is demanded within a stroke, not across a sheet.

That single clause is what licenses ordinary drafting convention: a heavier outline for visible edges, a lighter stroke for hatching and hidden detail, a distinct weight for lead lines. What it does not license is decorative variation. If a reviewer cannot say what a given weight signifies, it is not a permitted difference in meaning – it is inconsistency.

Two conventions push this further. Sectional hatching under 37 CFR 1.84(h)(3) is mandatory rather than optional, so those thin oblique lines must be dense enough to survive reduction even though they are the finest strokes on the sheet. And in design practice, line type becomes claim scope: solid lines claim, broken lines disclaim. We unpack that in design patent broken lines.

The corollary is that a design application cannot be rescued by re-weighting lines after the fact. Changing a solid line to a broken one changes what is claimed, which is why line decisions in a design case are drafting decisions, not formalities.

Rule 4: PCT Rule 11.13 and the 0.32 cm Character Height

If the application is going international, the controlling text is PCT Rule 11.13, and its opening paragraph will look familiar. Rule 11.13(a): “Drawings shall be executed in durable, black, sufficiently dense and dark, uniformly thick and well-defined, lines and strokes without colorings.” The US and international standards are, almost word for word, the same standard.

Rule 11.13(c) then states the reduction test explicitly rather than by implication: the scale and the distinctness of the graphical execution must be such that a photographic reproduction with a linear reduction in size to two-thirds would let every detail be distinguished without difficulty. Same two-thirds, stated as a design constraint.

Rule 11.13 also supplies the hard number practitioners look for and rarely find in 37 CFR 1.84: under Rule 11.13(h), the height of the numbers and letters shall not be less than 0.32 cm. The US rule reaches the same figure by a different route, requiring reference characters, sheet numbers and view numbers to be at least 0.32 cm (1/8 inch) high. Set your text at 0.32 cm and both offices are satisfied.

One more paragraph is worth knowing because it is where hand-annotated figures come unstuck: Rule 11.13(f) says all lines in the drawings shall ordinarily be drawn with the aid of drafting instruments. Because the wording is shared, patent drawing line thickness is one of the few formalities you can genuinely draft once. A figure prepared to satisfy 37 CFR 1.84(l) will normally clear PCT Rule 11.13(a) untouched, which is worth knowing before anyone commissions a second set of sheets for the international filing.

Rule 5: European Practice After Rule 46 EPC Was Deleted

A great deal of published guidance still cites Rule 46 EPC for the form of European drawings. That citation is now wrong. Rule 46 EPC is marked “(deleted)”, along with paragraphs (3) to (12) of Rule 49 EPC, as part of the amendment package that entered into force on 1 February 2023.

Nothing was relaxed. The requirements were moved out of the Implementing Regulations and into a decision of the President of the EPO, so that presentation standards can track the office’s digital filing systems without an Administrative Council amendment each time. The substance now reaches practitioners through that decision and through the Guidelines for Examination, Part A, Chapter IX.

For line weight the European standard is the familiar one: lines and strokes must be durable, uniformly thick and well-defined, and the drawing must remain legible through the office’s own reproduction. Rule 6: Colour and Greyscale at the EPO Since 1 October 2025

The second European change is more consequential than the renumbering. Following a decision of the President of 7 July 2025 (OJ EPO 2025, A49), with an explanatory notice at OJ EPO 2025, A57, the EPO accepts colour and greyscale drawings in applications filed by electronic means from 1 October 2025. Drawings filed electronically in colour are now published in colour rather than being converted to black and white.

The line requirement did not disappear with the colour bar; it was restated. Colour and greyscale drawings must still be executed in durable, uniformly thick and well-defined lines, strokes or areas, must be sufficiently rich in contrast, and must display clearly at 300 dpi. Contrast is the new failure mode: a pale tint that reads as a distinct region on a calibrated monitor can collapse into the background at publication density.

Treat the export profile as part of the drawing, not as an afterthought. Most firms that stop seeing informality notices did so by fixing one export template, because patent drawing line thickness fails systematically rather than figure by figure – the same bad profile ruins every sheet it touches.

Two limits matter. The route is only open to drawings filed by electronic means – colour sheets posted on paper are not eligible. And it is a European development only: in the United States, colour still requires the petition and fee route under 37 CFR 1.84(a)(2), and in a design application the separate regime of 37 CFR 1.152 applies. Rule 7: The CAD and Vector Exports That Quietly Break Line Weight

Almost every line objection we see began as a correct drawing that was exported badly. The geometry was right; the export destroyed the strokes. Five settings account for most of it, and all five are invisible in the source file.

  • Hairline pen weights. A hairline is defined as the thinnest mark the output device can make, so it scales down with resolution and vanishes on reduction. Assign a real width instead.
  • Anti-aliasing on raster export. Smoothing turns a crisp black edge into a grey gradient, which fails the “sufficiently dense and dark” test even though it looks better on screen.
  • Greyscale construction geometry. Centre lines, dimension lines and layer colours exported as grey are still grey after conversion. Force every printing layer to pure black.
  • Scale-dependent line weights. Weights tied to viewport scale change when the sheet is placed. Lock them, then check the placed view rather than the model space.
  • Low-resolution raster output. Below roughly 300 dpi at final sheet size, fine hatching aliases into a dotted texture that no longer reads as a line.

The reliable test costs a minute. Export the sheet, print it at 67% of filing size on an ordinary office printer, and look at the densest region of hatching. If the strokes merge, grey out or break up, the file is not ready – and no amount of arguing about monitor calibration will change the reproduction the office actually makes.

A Seven-Point Line Check Before You File

Run this before the drawings leave your desk. It takes less time than a response to a notice of informal drawings, and it catches the failures that actually recur.

  • Every printing stroke is pure black, not a grey, tint or screen – except where the EPO colour route is deliberately being used.
  • No hairline or zero-width pens survive anywhere in the export.
  • Each individual stroke is uniform along its length: no tapering, no thinning at curves.
  • Where weights differ, each weight has a stated meaning – outline, hidden detail, hatching, lead line.
  • Sectional hatching remains separable at 67% linear reduction.
  • Reference characters, sheet numbers and view numbers are at least 0.32 cm high.
  • Output is at least 300 dpi at final sheet size, with anti-aliasing off.

If a figure fails any line on this list, fix the drawing rather than the argument. Formal drawings that comply on filing avoid the replacement-sheet cycle entirely, and they keep the disclosure fixed at the date you actually needed it.

Is Rule 46 EPC still the right citation for European drawing form?

No. Rule 46 EPC was deleted, together with Rule 49(3) to (12) EPC, with effect from 1 February 2023.
