Figure numbers look like the most trivial part of a drawing set, right up to the morning an examiner objects to them and your filing date is suddenly tangled in a correction. Patent drawing figure numbering is governed by its own short, unforgiving paragraph of the rules, and almost every objection we see comes from the same handful of habits: numbering figures to match sheets, dropping a number when a figure is cancelled, or dressing up a figure number in circles and brackets. Here are the rules that actually control, in the three offices most applications pass through.
Patent Drawing Figure Numbering Under 37 CFR 1.84(u)

The operative US provision is 37 CFR 1.84(u)(1), and it is worth reading in full because it does four separate jobs in one sentence. It requires that “[t]he different views must be numbered in consecutive Arabic numerals, starting with 1, independent of the numbering of the sheets and, if possible, in the order in which they appear on the drawing sheet(s).”
Unpacked, that gives you four obligations:
- Arabic numerals only. Not Roman numerals, not letters standing alone, not “Figure One”.
- Consecutive, starting at 1. No gaps, and no starting at FIG. 0 or FIG. 2.
- Independent of sheet numbers. This is the rule most often broken โ see the next section.
- In order of appearance where possible. A reader working left to right, top to bottom, should meet the figures in sequence.
The same paragraph adds the prefix rule: view numbers “must be preceded by the abbreviation ‘FIG.'” And it carves out the single-figure case โ where only one view is used to illustrate the claimed invention, it must not be numbered and the abbreviation “FIG.” must not appear. That carve-out catches a surprising number of simple mechanical and design filings, where a draftsperson labels a lone figure “FIG. 1” out of habit.
Getting patent drawing figure numbering right at the draft stage costs nothing. Fixing it later means a replacement sheet, a corresponding amendment to the brief description, and a round of attorney time that no client enjoys reading on an invoice.
Sheet Numbers and Figure Numbers Are Two Different Sequences
This is the single most common error, and it comes from an intuition that feels tidy: if FIG. 3 sits on sheet 3, surely everything lines up. It does not, and the rules deliberately keep the two sequences apart.
Sheet numbering lives in a different paragraph โ 37 CFR 1.84(t) โ which provides that the sheets “should be numbered in consecutive Arabic numerals, starting with 1, within the sight as defined in paragraph (g).” Sheet numbers are placed in the middle of the top of the sheet, and are written as two Arabic numerals separated by an oblique line, with the first the sheet number and the second the total count: 1/4, 2/4, 3/4, 4/4.
So a four-sheet application can perfectly properly carry nine figures, with FIG. 1 and FIG. 2 on sheet 1/4, FIG. 3 alone on sheet 2/4, and so on. Nothing requires the counts to match, and forcing them to match โ by splitting a figure across sheets, or padding sheets out โ usually produces a worse drawing set.
Two practical consequences follow. First, if you add a sheet during prosecution, the sheet count in every “x/y” label changes, but the figure numbers need not. Second, if you cancel a figure, the figure sequence changes but the sheets may not. Treat them as independent registers and the bookkeeping stops being confusing. Partial Views, Enlargements and the Capital-Letter Convention

Large assemblies frequently will not fit legibly on one sheet at a scale an examiner can read. Rule 1.84(u)(1) anticipates this: “[p]artial views intended to form one complete view, on one or several sheets, must be identified by the same number followed by a capital letter.”
So a chassis drawn across three sheets becomes FIG. 4A, FIG. 4B and FIG. 4C โ not FIG. 4, FIG. 5 and FIG. 6. The letter suffix is the signal to the examiner that these fragments are one view, and that the next independent view is FIG. 5.
Where the letter convention gets misused is enlargements. A detail blow-up of a region of FIG. 4 is a separate view of the invention, not a fragment that assembles into FIG. 4, so it is cleaner and safer to give it its own number and identify the enlarged region in the brief description. If you do label it 4B, make sure the specification says plainly that FIG. 4B is an enlarged view of a portion of FIG. 4 โ an inconsistency between the label and the text is exactly what draws an objection.
Note also 37 CFR 1.84(i): one view must not be placed upon another or within the outline of another, and all views on a sheet should stand in the same direction. An inset detail floating inside the outline of its parent figure breaks that rule regardless of how it is numbered. Formatting: Keep Figure Numbers Plain
37 CFR 1.84(u)(2) is a one-line rule with real teeth: “Numbers and letters identifying the views must be simple and clear and must not be used in association with brackets, circles, or inverted commas.”
That rules out several conventions imported from engineering and CAD practice:
- Circled figure numbers, a standard balloon convention in manufacturing drawings.
- Bracketed numbers such as (FIG. 1) or [1].
- Quoted or primed numbers โ FIG. “1” or FIG. 1′.
- Decorative frames, drop shadows or reversed-out white-on-black labels.
The parallel rule for reference characters โ the numerals pointing at individual elements inside a figure โ is 37 CFR 1.84(p). It requires reference characters, sheet numbers and view numbers to be plain and legible and not used with brackets or inverted commas, and sets a minimum character height of 0.32 cm (one-eighth of an inch). Size matters for figure labels too. A figure number set in a light hairline font may survive on screen and disappear entirely when the application is scanned and reproduced โ and the reproduction quality standard, not your monitor, is what the Office applies.
Design Patents: 37 CFR 1.152 Sends You Back to 1.84
Design applicants sometimes assume a separate numbering regime applies. It does not. 37 CFR 1.152 provides that “[t]he design must be represented by a drawing that complies with the requirements of ยง 1.84 and must contain a sufficient number of views to constitute a complete disclosure of the appearance of the design.”
So the 1.84(u) numbering rules apply in full to design figures. What differs is everything around them. Rule 1.152 adds that appropriate and adequate surface shading should be used to show the character or contour of the surfaces; that solid black surface shading is not permitted except to represent the color black or color contrast; that broken lines may show visible environmental structure but may not show hidden planes and surfaces that cannot be seen through opaque materials; and that alternate positions of a design component shown in full and broken lines in the same view are not permitted.
Because a design application claims what the figures show, the practical risk of a numbering slip is higher than in a utility case. A design set usually runs front, rear, left, right, top, bottom and perspective. If the brief description says FIG. 5 is the bottom plan view and the sheet labels it FIG. 6, the record now contains two inconsistent statements about the claimed design. That is not merely a formality โ it is an ambiguity in the claim itself.
One more 1.152 point worth remembering: photographs and ink drawings may not be combined as formal drawings in one application, and photographs filed in lieu of ink drawings in a design application must be limited to the claimed design and must not disclose environmental structure.
Europe: Rule 46 EPC Is Gone โ Here Is What Replaced It

A great deal of published guidance โ including, candidly, older pages on plenty of IP firm websites โ still cites Rule 46 EPC as the European provision on the form of drawings. That citation is now wrong, and it is worth being precise about why.
At its 172nd session on 13 October 2022 the Administrative Council adopted CA/D 10/22, a package of amendments supporting the digitalisation of the grant procedure. Under it, Rule 46 EPC and Rule 49(3)โ(12) EPC were deleted, and their content was moved into a Decision of the President of the EPO, with Rules 49(2), 50, 57 and 82 adapted to match. The change entered into force on 1 February 2023. The EPO’s own legal texts now show Rule 46 simply as “(deleted)”.
The substance did not change on that date โ the point of the reform was to let the Office update presentation requirements by presidential decision rather than by amending the Implementing Regulations. So the European drawing standards survive; they just live in Rule 49 EPC, the Decision of the President made under it, and Part A, Chapter IX of the Guidelines for Examination.
On numbering itself, European practice tracks the US closely. Figures are numbered consecutively in Arabic numerals, independently of the numbering of the sheets, and a single figure need not be numbered. Sheets are numbered in consecutive Arabic numerals, centred at the top of the sheet but not placed in the top margin. Reference signs not mentioned in the description must not appear in the drawings, and vice versa โ a consistency requirement that bites harder in Europe than in the US. If you maintain internal drawing checklists, this is the citation to fix. Referring an EPO formalities officer to a rule that no longer exists does not invalidate anything, but it does not inspire confidence either.
PCT Rule 11: One More Sequence to Keep Straight
International applications are governed by PCT Rule 11, and the numbering provisions are mercifully consistent with both offices above.
Rule 11.13(k) provides that “[t]he different figures shall be numbered in Arabic numerals consecutively and independently of the numbering of the sheets.” Rule 11.7 handles sheets: “[a]ll the sheets contained in the international application shall be numbered in consecutive Arabic numerals.”
The PCT twist is that sheet numbering runs across the whole international application, not merely the drawings. The request, description, claims, abstract and drawings each form part of a numbering scheme set out in Rule 11.7, so the drawing sheets are not a self-contained 1/4 to 4/4 set in the way a US filing’s are. Practitioners moving a US case into the international phase should expect the formalities officer to renumber sheets, and should not be alarmed when the drawing sheet labels change while the figure numbers stay put.
Because the figure numbers are stable across all three regimes, they are the safest thing to anchor your specification text to โ which is exactly the point of the independence rule. For a fuller treatment, see our guide to PCT drawing requirements.
Renumbering After Amendment โ Where Most Objections Actually Originate
Nearly every figure-numbering objection we are asked to clean up traces to the same event: a figure was added or cancelled mid-prosecution and only half the record was updated.
The failure mode is predictable. Counsel cancels FIG. 6 in response to a restriction requirement. The replacement drawing sheets go in correctly. The brief description of the drawings still describes seven figures. Or the reverse โ the brief description is amended, the sheets are not, and the application now claims a figure that does not exist.
A short discipline avoids all of it. When any figure changes, sweep four places in the same sitting:
- The figure labels on the drawing sheets themselves.
- The brief description of the drawings in the specification.
- Every in-text reference to that figure in the detailed description.
- The sheet count in each “x/y” sheet label, if the number of sheets changed.
On whether to renumber at all: if you cancel a middle figure, you can either renumber the later figures to close the gap โ which requires correcting every textual reference to them โ or leave the gap and explain it. Renumbering produces a cleaner final patent; leaving the gap produces far fewer opportunities to introduce an error. For a late-stage amendment in a case with heavy figure cross-referencing, the conservative choice is usually to avoid a cascading renumber. Consistent patent drawing figure numbering across the sheets and the specification is, in the end, a proofreading problem rather than a legal one โ which is precisely why it is worth systematising instead of trusting to a final read-through at 6pm on the filing deadline.
