- Section 1201(a)(1) — the conduct ban. It is unlawful to circumvent a technological measure that effectively controls access to a protected work. This is the only provision that reaches the act of circumvention itself.
- Section 1201(a)(2) — trafficking in access-circumvention tools. Manufacturing, importing, offering to the public or trafficking in a technology primarily designed to circumvent an access control.
- Section 1201(b)(1) — trafficking in copy-circumvention tools. The same trafficking ban for technologies that circumvent measures protecting a right of the copyright owner — typically copy controls.
The asymmetry is the part practitioners miss. There is no general statutory prohibition on the act of circumventing a copy control, only on trafficking in the tools that do it. Congress drew that line so that a user exercising a lawful privilege, such as fair use, over a copy they already have lawful access to is not automatically an infringer of section 1201 — even though obtaining a tool to do it may still be unlawful.
Section 1201 also carries permanent statutory exemptions that do not depend on any rulemaking: nonprofit libraries, archives and educational institutions making an acquisition decision; law enforcement and intelligence activities; reverse engineering for interoperability of an independently created program; good-faith encryption research; protection of minors; protection of personally identifying information; and good-faith security testing. Each carries its own conditions, and the interoperability and security-testing exemptions in particular are narrower in practice than their headings suggest.
On top of those sits the triennial rulemaking. Under section 1201(a)(1)(C) the Librarian of Congress, on the recommendation of the Register of Copyrights, may exempt classes of works from the conduct ban for the following three-year period. These exemptions expire and must be renewed, they apply only to the conduct ban and not to the trafficking provisions, and that last point is what hollows many of them out: a user may be permitted to circumvent while nobody is permitted to supply them the means.
Digital Rights Management Outside the United States
Anti-circumvention law is not a US invention. It originates in the WIPO Copyright Treaty, whose Article 11 requires contracting parties to provide adequate legal protection and effective remedies against the circumvention of effective technological measures. Article 18 of the WIPO Performances and Phonograms Treaty does the same for performers and phonogram producers. The DMCA was the US implementation; other countries implemented the same obligation differently.
In the European Union, Article 6 of the Information Society Directive (2001/29/EC) requires member states to provide adequate legal protection against circumvention of effective technological measures, and against trafficking in circumvention devices. So far this tracks the US model.
Article 6(4) is where the approaches part company. It requires member states to take appropriate measures to ensure that beneficiaries of certain copyright exceptions can actually benefit from them, where rightholders have not done so voluntarily. In other words, EU law contains an express mechanism intended to stop technological measures from overriding statutory exceptions. US law has no equivalent: the triennial rulemaking is a discretionary safety valve, not a right the beneficiary can enforce against a rightholder.
For any business shipping a protected product internationally, the operational consequence is that a single global digital rights management posture is rarely correct. The technical measure can be uniform; the documentation, the exception-handling process and the response to a lawful-access request should not be.
