Nobody hires a patent illustrator to write. Yet nearly every figure carries some text, and the paragraphs governing it are among the least-read in 37 CFR 1.84. Patent drawing legends – the short descriptive labels placed on a figure – are expressly permitted at the USPTO, allowed only in a much narrower form at the EPO, and capped by treaty under the PCT. Get the balance wrong and you collect a formalities objection on an otherwise clean set of sheets. Get it wrong the other way and an examiner asks you to delete wording the specification depends on.
What Patent Drawing Legends Are Under 37 CFR 1.84(o)

A legend is a word or short phrase written on the face of a figure to say what something is or what is happening – PRIOR ART, INLET, SECTION ON A-A, START, ENCRYPTED PAYLOAD. It is not a reference numeral, and it is not the brief description of the drawings that sits in the specification. It is text living on the sheet itself.
The controlling US provision is 37 CFR 1.84(o), and it is two sentences long: “Suitable descriptive legends may be used subject to approval by the Office, or may be required by the examiner where necessary for understanding of the drawing. They should contain as few words as possible.”
Three things follow from that wording, and practitioners routinely miss all three.
- Legends are permissive, not automatic. The rule says they “may be used subject to approval by the Office.” A draftsperson’s objection to a legend is not a misreading of the rule; it is the rule operating as written.
- An examiner can compel one. The same sentence lets the examiner require a legend where it is necessary to understand the drawing. This is how flowcharts and block diagrams with unlabelled boxes get objected to.
- Brevity is a stated requirement. “As few words as possible” is regulatory text, not style advice. A sentence on a figure is a legend that has stopped being a legend.
There is one further US-specific piece of on-sheet text that is governed separately: the copyright or mask work notice under 37 CFR 1.84(s). It may appear on the drawing, but it must sit within the sight immediately below the figure it relates to, its characters must be between 0.32 cm and 0.64 cm (1/8 to 1/4 inch) high, its content is limited to what the statute permits, and the specification must carry the authorisation language required by 37 CFR 1.71(e). It is the one legend with a prescribed type size.
Graphical Symbols Must Be Identified in the Specification
Legends have a close cousin that trips up electrical and chemical engineering cases: the graphical symbol. 37 CFR 1.84(n) provides that “[g]raphical drawing symbols may be used for conventional elements when appropriate. The elements for which such symbols and labeled representations are used must be adequately identified in the specification.”
The rule then splits symbols into two classes. “Known devices should be illustrated by symbols which have a universally recognized conventional meaning and are generally accepted in the art. Other symbols which are not universally recognized may be used, subject to approval by the Office, if they are not likely to be confused with existing conventional symbols, and if they are readily identifiable.”
In practice that means an IEEE resistor, a standard logic gate, a ANSI/ISA valve symbol or a conventional benzene ring needs no explanation – but a bespoke icon you invented for your own architecture diagram does, and it must be explained in the written description rather than in a legend on the sheet. This is the single most common reason a software or systems figure survives formalities but fails to support the claim it was drawn for: the symbol is on the drawing and nowhere in the specification.

Chemical Formulae, Tables and Waveforms Count as Drawings

37 CFR 1.84(d) is short, easily overlooked, and decides how a great many pharmaceutical, materials and signal-processing applications are assembled. It provides that “[c]hemical or mathematical formulae, tables, and waveforms may be submitted as drawings, and are subject to the same requirements as drawings.”
“Subject to the same requirements” is the load-bearing phrase. A structural formula filed as a figure inherits the whole of Rule 1.84 – margins, line quality, lettering height, sheet numbering and the text restrictions discussed here. It is not a piece of typesetting that happens to sit on a drawing sheet.
The paragraph then adds three specific obligations:
- Each chemical or mathematical formula must be labeled as a separate figure, “using brackets when necessary, to show that information is properly integrated.” Five structures on one sheet are five figures, not one.
- Each group of waveforms must be presented as a single figure, “using a common vertical axis with time extending along the horizontal axis.” You cannot scatter related traces across separate figures with independent time bases.
- Each individual waveform discussed in the specification must be identified with a separate letter designation adjacent to the vertical axis – so the description can point at trace (a) rather than at “the third line down.”
Those letter designations are, in the terms of this article, legends – and they are ones the rule effectively mandates. The related question of when a table belongs in the specification rather than on a sheet is worth settling before drafting, because tables submitted as drawings must then meet the same lettering-height and reduction-legibility standards as every other figure.
Legends Are Not Reference Characters, and the Rules Differ
Conflating the two is the most frequent drafting error we correct. Reference characters are governed by 37 CFR 1.84(p), which requires that “[r]eference characters (numerals are preferred), sheet numbers, and view numbers must be plain and legible, and must not be used in association with brackets or inverted commas.” Legends are governed by 1.84(o). They do different jobs and answer to different tests.
A reference character is an index: it points from the drawing into the specification, where the element is named and described. A legend is a caption: it names something on the face of the sheet, without the specification necessarily doing any work. That is precisely why offices distrust legends – a legend can introduce matter that appears nowhere in the description, and matter that appears only in a drawing is a familiar route into an added-matter or written-description problem.
Lead lines, under 1.84(q), are the third element in the same system: “Lead lines are those lines between the reference characters and the details referred to.” They belong to numerals, not to legends. A lead line running from a legend to a feature is a hybrid the rules do not contemplate, and it reads as an attempt to make a caption do a numeral’s job.
The practical rule we apply: if the specification describes the element, use a numeral. Reserve legends for things a numeral genuinely cannot express – an orientation, a state, a section plane, a process step boundary, or the fact that a figure is prior art.
The EPO Is Far Stricter, and Rule 46 EPC No Longer Says So
European practice on patent drawing legends is materially tighter than US practice, and the legal basis for it changed in a way many published guides have not caught up with.
Until recently the requirement sat in Rule 46(2)(j) EPC. Rule 46 EPC was deleted with effect from 1 February 2023, by the Administrative Council decision CA/D 10/22 of 13 October 2022, as part of the EPO’s digital-transformation package. Rules 49 and 50 EPC were amended at the same time so that the President of the EPO, rather than the Implementing Regulations, sets the presentation requirements for application documents. The substance of the old rule was carried across essentially unchanged into a Decision of the President, and it is applied through the Guidelines for Examination and checked as a formal requirement under Rule 57 EPC.
If you are reading a guide – or an old file wrapper – that cites “Rule 46 EPC” as live authority for the form of drawings, it is citing a provision that no longer exists. The requirement survives; the citation does not.
The substance, set out at Guidelines A-IX, 8, is that drawings must not contain text matter except, when absolutely indispensable, a single word or a few words. Flow sheets and diagrams are treated as drawings, so the same ceiling applies to them – which is exactly where US-drafted block diagrams run into trouble on entry to the European phase. The Guidelines also ask applicants to leave space around any permitted words so a translation can be pasted over them without running into drawing lines.
One recent change is worth noting because it is often confused with the text rules: since 1 October 2025 the EPO accepts colour and greyscale drawings on electronically filed applications, under a Decision of the President at OJ EPO 2025, A49, provided the drawings are sufficiently rich in contrast and clearly displayable at 300 dpi. That concession is about colour, not about text – the text ceiling is unchanged. PCT Rule 11.11 Sets the Treaty Ceiling
If the application is going through the PCT, the binding standard is PCT Rule 11.11, and it is worth reading in full because it names its own examples.
Rule 11.11(a) provides that “[t]he drawings shall not contain text matter, except a single word or words, when absolutely indispensable, such as ‘water,’ ‘steam,’ ‘open,’ ‘closed,’ ‘section on AB,’ and, in the case of electric circuits and block schematic or flow sheet diagrams, a few short catchwords indispensable for understanding.”
Two points repay attention. First, the carve-out for circuits and block or flow diagrams is real – WIPO’s own guidance accepts that identifying catchwords for functional blocks of a complex system may be indispensable in practice where they are needed for a diagram to be read quickly and clearly. A block labelled with a short functional catchword is defensible; a block containing a sentence is not.
Second, Rule 11.11(b) requires that any words used be placed so that, if translated, they may be pasted over without interfering with any lines of the drawing. That is a layout instruction with real consequences: text crowded against geometry cannot be overlaid, and the receiving Office or the International Bureau will say so. Leave a clear band around every permitted word.
Because the PCT standard is the narrowest of the three in practical terms, drawing to it first is the cheapest way to produce one set of sheets that clears all three routes. The rest of the international formal requirements are set out in our guide to PCT drawing requirements.
Design Patents: Where Patent Drawing Legends Do the Claiming
Design applications invert the usual relationship between text and figure. Under 37 CFR 1.152, the design must be represented by drawings that comply with 37 CFR 1.84 and contain a sufficient number of views to constitute a complete disclosure of the appearance – and the drawing is the claim. There are no reference numerals to carry meaning, so the little text a design sheet is allowed to carry does disproportionate work.
Two conventions matter. View legends – FIG. 1 is a front perspective view and so on – sit in the specification rather than on the sheet. But statements explaining what broken lines represent, and any disclaimer of unclaimed environmental structure, are how an applicant tells the examiner and the public what is and is not being claimed.
37 CFR 1.152 also supplies the draughting constraints that make those statements necessary: appropriate and adequate surface shading should be used to show the character or contour of the surfaces represented; solid black surface shading is not permitted except when used to represent the colour black or colour contrast; and broken lines may be used to show visible environmental structure, but may not be used to show hidden planes and surfaces that cannot be seen through opaque materials.
One further design-specific point that surprises utility practitioners: photographs and ink drawings are not permitted to be combined as formal drawings in one application. A Working Checklist for Patent Drawing Legends
Before a set of sheets leaves our desk, the text on every figure is checked against the office it is actually going to. The checklist is short:
- Could a reference numeral carry this instead? If yes, use the numeral and delete the legend. Numerals travel between jurisdictions; legends do not.
- Is every word on the sheet indispensable? Apply the PCT test even on a US-only filing. It costs nothing and it future-proofs the set.
- Is any symbol on the sheet explained in the specification? 1.84(n) requires it, and no legend cures the omission.
- Is there clear space around each permitted word for a pasted translation, as PCT Rule 11.11(b) requires?
- Are formulae labelled as separate figures, and are waveform traces lettered against a common vertical axis, as 1.84(d) requires?
- Does any legend introduce matter that is not in the description? If so, either add it to the description or remove it from the sheet – never leave it stranded on the drawing.
- Is the same wording used in every family member? Divergent legends between the US, European and PCT copies of a figure invite an argument that the documents disclose different things.
None of this is difficult. It is simply detail that gets skipped when figures are exported from CAD or lifted out of a technical report, and it is cheaper to fix before filing than after a notice of draftsperson’s objection.
